Why you need it

When you need it

One family member gives up a share to another, for money — state the consideration openly. A genuine release (Art. 55); s.17(1)(b) requires registration since it extinguishes a right. State pre-existing interests, relationship, share, amount, payment method, possession, permissions. Do not disguise a stranger-sale as a family release. Punjab authority and Chandigarh sector property still need their own permission or update.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

Punjab: release under Article 55. Duty fully remitted on a lifetime transfer to a 'blood relation' (Order S.O.28/2014: children, grandchildren, siblings ONLY). No published rate outside that — get it from the Sub-Registrar; do not assume the 5% sale rate. Duty on consideration or Collector rate, higher. Chandigarh: blood-relation transfers exempt; calculator otherwise shows Rs 15 flat or 8%/6% for a non-ancestral release — confirm at the Sub-Registrar. Stamp before or at signing (s.17); unstamped is inadmissible until penalty is paid (s.35).

Registration

Compulsory (s.17(1)(b)); present within four months (s.23). Fee: Punjab 1% (min Rs 50, max Rs 2,00,000) plus Rs 200 pasting; Chandigarh 1% capped at Rs 10,000 plus Rs 20 pasting.

Notarisation

Does not replace registration.
