Why you need it

When you need it

An HUF dividing coparcenary property by written deed — identify the property, Karta, every coparcener, share calculation first. S.6, Hindu Succession Act, 1956 gives daughters coparcenary status by birth, equal to sons — no male-only list. A deed creating separate title needs registration (s.17(1)(b)) as a partition instrument (Article 45); HUF tax recognition (s.171) is separate. Punjab authority and Chandigarh sector property remain subject to local rules.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

Article 45. Punjab: no published rate — get it assessed by the Tehsildar. Duty falls only on the smaller shares separated (four equal sharers pay three-quarters of value; a two-thirds sharer separating pays one-third — Stamp Manual note 84). Chandigarh: 2%. Stamp before or at signing (s.17); unstamped is inadmissible until penalty is paid (s.35).

Registration

Compulsory (s.17(1)(b)); 4 months to present (s.23). Fee: Punjab 1% (min Rs 50, max Rs 2L) + Rs 200 pasting; Chandigarh 1% cap Rs 10,000 + Rs 20 pasting.

Does not replace registration.

What this document is for

A Hindu Undivided Family in Punjab or Chandigarh uses this to divide its coparcenary property by a written, registered deed — naming the Karta, every coparcener, and exactly what each of them is allotted. Since the 2005 amendment to the Hindu Succession Act, a daughter is a coparcener by birth on exactly the same footing as a son, so there is no male-only list here: every daughter entitled to a share has to be named and allotted one, just as a son would be.

This is specifically for Hindu coparcenary property — property the family holds under Hindu law as an undivided family, not simply any property several people happen to co-own. Where the joint holding is not that kind of HUF property, the general, all-India Partition Deed is the document to use instead.

Before you use this — registering the deed is not the same as tax recognition

Registering this deed gives the division legal effect between the family members and starts the process of updating the land or estate record. But the Income-tax Department only recognises the Hindu Undivided Family as actually partitioned once a separate application is accepted under section 171 of the Income-tax Act, 1961 — this deed does not itself state, or achieve, that recognition. Until that separate step is taken, the family may still be assessed as an undivided HUF for tax purposes even though the property has been legally split between the coparceners.

Stamp paper and registration

Stamp paper needed

Yes

Typical stamp duty — Punjab

Ask usPunjab publishes no rate at all for this article — the template states plainly that the duty has to be assessed case by case by the Tehsildar. What is settled is the basis it is worked out on: duty falls only on the value of the smaller shares actually separated out, with the largest share excluded, following a specific note in the Punjab Stamp Manual — but the percentage itself is not published anywhere, so get it assessed before relying on a figure.

Typical stamp duty — Chandigarh

2%, under Article 45, on the value of the shares the partition actually separates out.

Registration at the Sub-Registrar

Yes Compulsory. Present within four months of execution — registration is what actually creates separate, exclusive title in each coparcener's allotted share.

Notary or witnesses

Notarisation does not replace registration. The template found no specific statutory witness requirement for a partition deed, though attending with identifiable witnesses is standard practice at the registration counter.

What you will need before you start

  • The Hindu Undivided Family's name and the identity of the Karta
  • A full list of every coparcener, including every daughter by birth regardless of her marital status or where she lives
  • How the family property is presently held — Punjab freehold or revenue-record property, a Punjab development-authority allotment, or a Chandigarh sector, estate or revenue-village property
  • The property's identifying particulars and its present assessed value
  • What is being allotted to each coparcener, described by measurements and boundaries
  • Whether any equalisation payment is needed between coparceners receiving portions of unequal value

Common mistakes

  • Assuming registering this deed also settles the family's income-tax position — that needs its own separate recognition under section 171 of the Income-tax Act.
  • Leaving a daughter off the coparcener list because she is married or lives elsewhere — she remains a coparcener by birth regardless.
  • Dividing a Chandigarh sector property into physical floors or portions without first checking the Estate Office's fragmentation rules.

Questions people ask before using this document

Do my brothers' married daughters also count as coparceners?

Yes — since the 2005 amendment to section 6 of the Hindu Succession Act, a daughter is a coparcener by birth on exactly the same footing as a son, regardless of her marital status or where she now lives.

How much stamp duty does this deed cost in Punjab?

Punjab has no published rate for this — the duty is assessed case by case by the Tehsildar, and it is charged only on the value of the smaller shares actually separated out, not on the value of the whole family property.

Is Chandigarh cheaper than Punjab for this kind of deed?

Chandigarh charges a flat 2% under Article 45. Punjab, by contrast, has no published rate at all and needs a case-by-case assessment from the Tehsildar — the two places genuinely work this out differently, not just at different rates.

Once this deed is registered, is our family automatically treated as split for tax purposes?

No. Registering this deed gives the division legal effect and starts the land-record update, but the Income-tax Department only recognises the family as partitioned once a separate application is accepted under section 171 of the Income-tax Act, 1961.

Can we divide a Chandigarh sector house into separate floors for each coparcener?

Be careful — Chandigarh's Estate Rules and a Supreme Court decision restrict fragmenting or apartmentalising a residential unit in Phase-I. Check the Estate Office's position before dividing a sector site or building by metes and bounds.
