Get a Non-Encumbrance Certificate whenever someone needs proof of what's registered against a property — buying and checking the deed/mortgage chain, a bank's 13- or 30-year search before a loan, an intkal or transfer permission that wants an NEC on file, or a disputed/inherited holding needing a dated record. Sellers get one too, and buyers should get a fresh one 3-4 weeks after their own purchase to confirm the deed was actually indexed. File with the Sub-Registrar/Joint Sub-Registrar for the tehsil (Tehsildar/Naib Tehsildar) — online via NECIS on rcms.punjab.gov.in, over the counter, or at a Sewa Kendra. A notified 3-day service, appeal to the SDM then the Deputy Commissioner. Understand its limit: it reports only what the REGISTERING office holds — nothing about the jamabandi, which is a separate track joined only at registration. Don't use it: to see the ownership record itself (get a fard jamabandi instead); to fix a wrong jamabandi entry (a fard badar); for a boundary question (nishandehi, a different service); or to check litigation beyond a registered lis pendens (use the property-under-litigation search). Not for Chandigarh sector property — there's no notified NEC service there; title runs through the Estate Officer's file, though a Chandigarh purchaser can still inspect the Sub-Registrar's Book No. 1 and index under section 57. Finally, it's not a title opinion: it can't show an equitable mortgage by deposit of title deeds, an unregistered agreement, an oral partition, a tenant in possession, or a statutory charge. Use it alongside the original deeds, the fard, the intkal history, an inspection and legal advice.

स्टाम्प ड्यूटी

No stamp duty — not an instrument under section 2(14), Stamp Act, 1899. A manual application may need a Rs 1.25 court-fee label (weakly sourced; some computerised counters have stopped asking); online filing has none. The real cost is a departmental search fee: facilitation Rs 100 + application fee Rs 2 + Rs 20 for the current year + Rs 10 per earlier year — about Rs 242 for a 13-year search, Rs 412 for 30 years; the portal computes the exact figure. NOT payable here, despite confusion: the Rs 200 pasting fee (for registered documents), the Rs 600 mutation fee (paid at intkal attestation), or the Rs 20/page copying fee (for a fard copy). A separate proforma affidavit, if the counter wants one, goes on its own Rs 10/15 stamp paper — a different document from this application. Chandigarh has no per-year search fee scheme — pay the Sub-Registrar's own inspection/copying charge instead (get the figure in writing). For context, Chandigarh's actual conveyance duty is stated at 5% (contested — portals say 6%) plus 1% registration fee capped at Rs 10,000 and Rs 20 pasting.

रजिस्ट्री

Not registrable — this is an APPLICATION under section 57, Registration Act, 1908: you present it, you don't register it. Filed with the Sub-Registrar/Joint Sub-Registrar for the tehsil (not the Patwari, Circle Revenue Officer, or Deputy Commissioner) — via NECIS online, over the counter, or at a Sewa Kendra. If the tehsil was reorganised mid-period, a second application at the other office may be needed. It's a notified 3-day service (2 more if filed at a Sewa/Fard/Saanjh Kendra), running only from a complete, acknowledged application — keep the dated acknowledgment with its number. Appeal delay to the SDM, then the Deputy Commissioner. What comes back isn't a registered document either — just a certified statement of what Book No. 1 and the section 55 index show for that property and period. Chandigarh has no notified NEC service, but section 57 still lets anyone inspect Book No. 1 and the index at the Sub-Registrar (30 Bays Building) — ask what form, fee and time that counter gives; there's no 3-day clock. The searches that actually decide a Chandigarh title are Know Your Property/Dues, a No Dues Certificate (15 days) and, for leasehold, the transfer NOC (50 days).

नोटरी

Not required on the application itself — signed, not sworn. A SEPARATE proforma affidavit is commonly asked for (property identity, no undisclosed encumbrance) — its own stamp paper, notarised or Executive Magistrate-attested; ask the counter which proforma. Attestation also comes in for: a POA holder applying (an unregistered POA is usually notarised); a company/trust/bank applicant (its authority letter, typically notarised); or a chakbandi renumbering mismatch (a declaration linking old and new numbers).

गवाह

None required — nobody is executing an instrument. Only the applicant(s) sign; a representative signs just the letter of authority, not the application. Don't confuse this with the two-witness rule on the sale/gift/mortgage deed that follows — a different document. The counter wants identity, not attestation: your ID proof and a working mobile number, since the acknowledgment arrives by SMS/OTP.

3. Period of search

Please search the registers of your office, including Book No. 1 and the index of properties maintained under Section 55 of the Registration Act, 1908, and certify every registered transaction affecting the property described above — sale, gift, exchange, mortgage, lease, agreement, release, relinquishment, partition, will registered in this office, attachment, or any other charge — for the period:

From 1 April 2026 to 2 April 2026, that is 25,000 years, both dates inclusive, and, so far as your record permits, down to the date on which the certificate is issued.

The earliest deed in the chain of title known to me is: Sale Deed dated 12.06.1991, registered as Document No. 2214 of 1991 in the office of the Sub-Registrar, Ludhiana (East), from Smt. Gurmeet Kaur to Sardar Jagtar Singh. The period asked for is intended to reach back to and include that document, and I request that the certificate record whether it does.

I am aware, or have been informed, of the following documents affecting this property, and request that the search specifically cover and reflect them: Mortgage Deed No. 887 of 2016 and Deed of Release No. 341 of 2021, both of this office.

A Non-Encumbrance Certificate has earlier been issued in respect of this property: NEC No. 4471 dated 18.09.2023, covering 01.01.1994 to 31.08.2023. This application is not for the balance period only. I request that the whole of the period stated above be searched afresh, so that any entry made, corrected or re-indexed since the earlier certificate is also picked up.

Where the revenue estate has been through chakbandi under the East Punjab Holdings (Consolidation and Prevention of Fragmentation) Act, 1948 at any time within the period, the killa and khasra numbers before repartition are not the numbers in use today, and entries from before repartition will have been indexed under the earlier numbers. So far as your record permits, please run the search under those earlier numbers as well, and record on the certificate the numbers actually searched.

If any part of the period lies in registers that have not been computerised, please treat this as an application for a manual search of those registers for that part, and inform me of the additional fee and the additional time required.


4. Purpose

The certificate is required for: Purchase of the property.

It is to be submitted to Punjab Gramin Bank, Jhande Branch, and I request that it be issued in a form and with the endorsements that a lender will accept.


5. What is requested

I request: a Non-Encumbrance Certificate for the property and the period stated in Part 3, setting out entry by entry every registered transaction disclosed by the search, or certifying that the search disclosed no such entry — whichever the result warrants.

I request that the certificate expressly record (a) the exact period searched, (b) the description, and the khewat, khatauni, khasra or killa numbers, under which the search was made, (c) the revenue estate, tehsil and district, and (d) the registers and indexes searched. Without those four particulars the certificate is of little use to a purchaser or to a lender, and cannot be checked against the fard.

If for any reason this office does not issue the certificate in the form asked for above, I request that I be told at the counter what it does issue on a search of this kind, and that the search be conducted and the result given to me in that form.

Certified copies also requested. In addition, please issue certified copies of the following: Certified copy of Sale Deed No. 2214 of 1991 and of Mortgage Deed No. 887 of 2016. I will pay the separate copying and certification charge for these.
