कब ज़रूरत पड़ती है

Holding a plot/house/SCO/SCF/booth from GMADA/GLADA/ADA/JDA/BDA/PDA is an ALLOTMENT, not a title deed. S.43(6), 1995 Act keeps the land with the Authority until every rupee is paid; s.43(7) bars transfer without its PRIOR permission. This pack asks for that. Selling first and applying after is NOT a cure — it breaches the allotment, the Estate Officer won't re-allot to your buyer, and the buyer gets a registered deed with no allotment behind it. The permission is a letter naming the transferee, not a transfer itself. After it issues, register the deed before the Sub-Registrar, THEN return for re-transfer (a separate service) — this application is the permission only. Money: GMADA processing fee Rs 2,500 (residential/houses) or Rs 5,000 (commercial); a transfer fee of 2.5%/5% of allotment price if sought BEFORE the conveyance deed; an extension fee half-yearly from year 4 absent completion. 'Within family' = father/mother/son/daughter/spouse/sibling — closed. GMADA's RTS form: 21 working days; appeal to the Additional Chief Administrator if it lapses. NOT for: a deceased allottee (separate 45-day succession transfer); a PAPRA-licensed builder site (NOC from the promoter instead, under PAPRA 1995/RERA 2016); mortgage permission/no-dues/conveyance/re-transfer (each its own form); a resumed or show-cause-pending property (resolve first); an unauthorised colony or lal dora holding; or Chandigarh (a different Act, 1952 — Punjab only). The permission authorises a deed — it is not one.

No stamp duty on the application — s.2(14): it asks for a discretion, not an instrument. Plain paper. The AFFIDAVITS are stamped: GMADA/GLADA forms specify Rs 25 non-judicial for both the allottee's and the transferee's affidavit (Article 4, Schedule I-A, Punjab). EVERY deponent needs their own paper — a joint allotment or a second transferee each add Rs 25. Buy as a Punjab e-stamp (igrpunjab.gov.in or SHCIL) IN THE DEPONENT'S OWN NAME — a mismatch is the commonest rejection reason. The real money is FEE, by demand draft: GMADA's processing fee Rs 2,500 (residential/houses) or Rs 5,000 (commercial/other); a transfer fee of 2.5%/5% of allotment price if sought BEFORE the conveyance deed; an extension fee half-yearly from year 4 (none before), of the allotment/auction price: 2% (years 4-5), 2.5% (6-8), 3% (9-10), 3.5% (11-12), 4% (13-15) — none for a State Govt/PSU allottee. All from GMADA's form, revised each 1 April. Real stamp duty is at the DEED: sale/gift 5% + 1% cess + 1% PIDB = 7%, on the higher of consideration or the Collector rate. Whether it's computed on the allotment price or the Collector rate is GENUINELY UNSETTLED — GMADA's form just says 'as applicable on the date of execution' — ask at the Sub-Registrar, S.A.S. Nagar. No gender concession traceable. Chandigarh is excluded — a different Act (1952), its own NOC procedure and unearned increase.

रजिस्ट्री

Nothing in THIS PACK is registered — s.17(1) doesn't catch a discretion-application or sworn affidavits. Filed at the Estate Officer's counter: GMADA (PUDA Bhawan, Sector 62, S.A.S. Nagar) or GLADA (near Rajguru Nagar, Ferozepur Road, Ludhiana). Fee by demand draft, refused if over 3 months old — take the dated receipt, since the notified period (Punjab Right to Service Act, 2011) runs from it. GMADA's RTS form: 21 working days (website: 15); GLADA: the same pair. Appeal delay to the Additional Chief Administrator. Registration becomes compulsory NEXT: the sale/gift deed, before the Sub-Registrar of the tehsil, within 4 months (s.23, Registration Act, 1908), +4 more on penalty (s.25). Punjab fee: 1%, capped Rs 2,00,000, plus facilitation, pasting and mutation fees. Slots/e-stamp on NGDRS (igrpunjab.gov.in), locked at registration. AFTER the deed registers, return to the Estate Officer for re-transfer — a SEPARATE 15-day notified service — why this application's prayer stops at the permission. A registered deed alone doesn't make the buyer the allottee until re-allotted. Chandigarh is outside this template — its own rules under the 1952 Act.

नोटरी

The application, schedule and enclosure list are signed, not sworn. Parts B and C affidavits MUST be sworn — unsworn is the commonest rejection reason — each deponent separately (allottee, joint allottees, transferee, second transferee). Sworn before an Oath Commissioner (P&H HC appointed, S.A.S. Nagar for GMADA/Ludhiana for GLADA) or a Notary (Notaries Act, 1952). The deponent appears IN PERSON with original photo ID; the officer administers the oath, seals, dates, and enters a serial number WRITTEN on the affidavit — a faint or undated seal fails. Notary fee: Rule 10, Notaries Rules, 1956. Liability-affidavit photos: recent passport-size, signed across, plus ATTESTED photos of the transferee's legal heirs (natural persons) — a surprise item, but required; a company substitutes a board resolution. Abroad: an Indian mission's consular officer needs no further authentication; a foreign notary needs an apostille first. Chandigarh follows a different office and Act.

गवाह

No attesting witness is prescribed for a s.43(7) application — the affidavit's oath does that work. Two witnesses at Part D are used anyway, since the Estate Office queries identity — they attest IDENTITY, not the application's truth; a witness must be an adult, not a party, with a full address and photo ID. The Authority insists every recorded allottee signs — GMADA wants signatures of all owners, self-attested photo ID both sides, and ATTESTED photos of the purchaser's legal heirs. An attorney needs a certified, current power of attorney filed. The DEED differs: a Punjab sale deed needs two witnesses before the Sub-Registrar (s.34, Registration Act, 1908); a gift deed ALSO needs s.123, Transfer of Property Act, 1882 attestation. Don't reuse a witness who takes anything under the deed, and never a minor. Chandigarh follows its own practice.

  1. THE APPLICANT ALLOTTEE

I, Harpreet Singh Gill, son / daughter / wife of Gurdial Singh Gill, resident of House No. 1204, Sector 70, S.A.S. Nagar 160071, mobile +91 XXXXX XXXXX, holder of Aadhaar card (self-attested copy enclosed), am the recorded allottee of the property described in the Schedule to this application. I am joined in this application by Jaspreet Kaur Gill, son / daughter / wife of Harpreet Singh Gill, resident of House No. 1204, Sector 70, S.A.S. Nagar 160071, who is a joint allottee of the same property, who signs this application together with me and who adopts the affidavit at Part B as his or her own. Wherever this application uses the word "I", it shall be read as "we", and wherever it uses "my", it shall be read as "our".

  1. THE PROPERTY

The property in respect of which this permission is sought is residential plot No. 1204, Sector 78, Mohali Urban Estate, S.A.S. Nagar, measuring 250 square yards, allotted to me by the Authority by letter of allotment or re-allotment No. GMADA/EO/UE-78/2016/4471 dated 1 April 2026 at an allotment or auction price of ₹42,50,000 (Rupees Forty Two Lakh Fifty Thousand only). Full particulars are set out in the Schedule below.

  1. STATUS OF THE CONVEYANCE DEED AND THE STATUTORY POSITION

Status of the conveyance deed in respect of the said property: not yet executed.

I am aware, and I accept, that under section 43(6) of the Punjab Regional and Town Planning and Development Act, 1995 the said property continues to belong to the Authority until the entire consideration money together with interest and all other dues payable to the Authority has been paid; and that under section 43(7) of that Act I may not transfer any of my rights in the said property except with the previous permission of the Authority and on such terms and conditions and on payment of such fees as the Authority may determine. This application is made for that previous permission, and I shall not execute any deed of transfer until the permission is granted to me in writing.

  1. STATUS OF CONSTRUCTION AND OF THE BUILDING

I state as follows: That the building raised on the said property is complete, the occupation certificate has been obtained from the Authority and there is no violation of the building rules.

Occupation certificate: GMADA/SDO(B)/OC/2021/1187
Extent of the building raised on the site: two storeys, being the ground floor and the first floor.
Sanction of the sewerage connection bearing No. GMADA/PH/SEW/2020/0912, a self-attested copy of which is enclosed with this application.

There is no violation of the building bye-laws, of the sanctioned building plan or of the zoning plan in respect of the said property, and no notice of unauthorised development under sections 87 to 90 of the said Act is pending against it.

  1. ENCUMBRANCES AND AUTHORITY TO SIGN

I state as follows: That the said property is free from every mortgage, lien, charge, gift, sale, agreement to sell and other encumbrance, and no stipulation restricting its transfer subsists.

Lender whose mortgage stood upon the said property and has since been redeemed: State Bank of India, Sector 70 Branch, S.A.S. Nagar. Where a lender is named here, that lender's redemption or no-objection letter is enclosed with this application.
This application is signed on behalf of the allottee by the attorney holder under the general power of attorney dated 12 January 2024, registered as document No. 3187 in Book No. 4 at the office of the Sub-Registrar, S.A.S. Nagar, executed by the allottee in favour of Sukhdev Singh, a certified copy of which is enclosed with this application.

There is no suit, appeal, revision, execution, attachment, injunction or other proceeding pending in any court, tribunal or authority in respect of the title to, or the possession of, the said property.

  1. DUES PAYABLE TO THE AUTHORITY

I state as follows: That there is no amount outstanding against the said property according to the account statement published on the Authority's website, and no demand of the Authority remains unpaid.

I have examined the account statement of the said property in the "Know your property details" section of the Authority's website. I undertake to pay any further instalment, interest, enhancement or additional price that the Estate Officer may determine and demand in respect of the said property, whether before or after the transfer now applied for, and I accept that on failure to pay, the Estate Officer may proceed under sections 45 to 48 of the said Act.

  1. THE INTENDING PURCHASER, DONEE OR TRANSFEREE

I wish to transfer the said property by way of sale to the following person or persons:

Relationship of the intending transferee to me: father. The Authority treats a transfer to a father, mother, son, daughter, husband, wife, brother or sister as a transfer within the family, and the relationship is stated here so that the Estate Officer may apply that definition to this application.
The consideration agreed between the parties for the proposed transfer is ₹1,15,00,000 (Rupees One Crore Fifteen Lakh only).
