Two-part pack for transferring a Chandigarh Housing Board leasehold flat — the Board is a separate landlord (roughly 62,000 flats) from the Estate Office, at 8 Jan Marg, not Sector 17-C. Part A: No Dues Certificate from the Accounts Officer (15 days). Part B: joint NOC for transfer of lease rights from the Secretary (20 working days, excluding the public notice period), which needs Part A's certificate attached. No sale completes without Part B; Part B isn't complete without Part A. The Board checks: the 5-year lock-in from physical possession has run (exception: General Self Financing Scheme, Sector 63, transferable earlier on a fee); no Deed of Conveyance already executed; dues clear; no title dispute; every page signed and dated; and — the one to read twice — the Board inspects only if a show-cause notice or survey report is ALREADY on the file, and officials say roughly 40,000 Board flats carry unauthorised-modification issues. Costs (separate from stamp duty): a processing fee by flat category (Rs 200–6,000), Rs 10,000 publication charge, and a transfer fee of 15% of consideration or the unearned increase (2.5% for a blood-relation transfer or spouse's name change), plus GST. Budget six to seven weeks realistically, not the headline 20 days. Not for: an already-freehold Board flat with a Deed of Conveyance executed (that's a mutation application instead); an Estate Office property (a Sector house, SCO, plot — different landlord, different Rule 7 route); a transfer on death (a separate 25-working-day service); a Small Flats Scheme unit (only the licence moves, and only if both allottee and co-allottee have died); wanting only the No Dues Certificate (file Part A alone); Punjab property; or commercial property (different fee bands and proforma). Two cautions: the Board's Charter says a 5-year lock-in, but the 1979 Regulations say 10 years (or until the price is paid in full) — get the position confirmed in writing if your possession is 5–10 years old. And where the Board built the flat but the Estate Officer allotted it, the Board's own records request from the Estate Officer takes 2–3 months — start Part A early.

Neither Part A nor Part B carries stamp duty — not an instrument under section 2(14), Stamp Act, 1899; plain paper. The affidavits and indemnity bonds DO — per the Board's own published note: Rs 5 stamp paper for each affidavit, Rs 15 for each indemnity bond (its wording mixes 'judicial' and non-judicial paper, but that's the Board's own figure and what the counter uses) — one sheet per deponent/bond. These small denominations qualify for e-Sampark's Rs 500 online cap. The deed that follows is NOT charged at the widely-quoted 5%/6% conveyance rate — a Board flat moves by a TRANSFER OF LEASE RIGHTS, charged at 3% (a transfer within blood relation is duty-EXEMPT entirely); confirm this at the Sub-Registrar, since using the wrong line overpays by 2%+ of the whole price. Registration fee is 1% capped at Rs 10,000 plus Rs 20 pasting. Duty is on the higher of consideration or the collector rate (Board flats run roughly Rs 7,200–11,000/sq.ft depending on floor). No gender concession exists. The Board's own money — processing fee (Rs 200–6,000 by category), Rs 10,000 publication charge, and the 15%/2.5% transfer fee plus GST — is separate from stamp duty entirely. Two Board sources disagree on which bank receives it (Axis/SBI vs. HDFC/online) — ask at the counter and keep the receipt.

रजिस्ट्री

Neither application is registrable — section 17, Registration Act, 1908 doesn't reach a No Dues or NOC request; nor are the affidavits/indemnity bonds. File at the Board, 8 Jan Marg, or online via Service Plus. What IS registrable is the deed of transfer of lease rights that follows — compulsorily, under section 17(1), Registration Act, 1908, at the Sub-Registrar (narrow hours, photos affixed). Section 23 gives four months from execution, extendable four more (s.25) at up to 10x the fee; absolutely time-barred after eight months. Registration fee 1% capped at Rs 10,000 plus Rs 20 pasting. Unlike an Estate Office property, the Board does NOT auto-mutate on registration — mutation is a SEPARATE 20-working-day application to the Accounts Officer, with its own form, indemnity bond, photographs and a certified copy of the registered deed. Budget for this extra step; a registered deed with no Board mutation isn't on the Board's record, and the next sale will stall on it. Also check: if no registered Sub-Lease Deed exists on your file yet, the NOC itself obliges the Board to execute one — expect that cost too.

नोटरी

Every affidavit MUST be sworn — before a Notary or Executive Magistrate, per the Board's own published note — covering the allottee's (and each further allottee's), the purchaser's (and each further purchaser's), and the attorney's where one acts; each on its own stamp paper, with the notary's register number and seal. The two applications (Part A/B) are NOT sworn — just signed and dated on every page. The indemnity bonds are executed before two WITNESSES, not notarised (though a notary attesting them anyway is accepted). A power of attorney copy must be notary-attested. Anything executed outside India needs embossing by the Chandigarh Finance Department first — this catches NRI sellers routinely and can't be fixed at the counter on the day. ID photocopies are self-attested; no notary needed for those.

गवाह

The applications need no witness — just every allottee's and purchaser's signature on every page, dated. The indemnity bonds DO need two witnesses each, with self-attested ID copies on file — pick uninvolved adults whose ID you can obtain. Also required: three self-attested photographs with specimen signatures split across photo and sheet, for both allottee and purchaser (formats vary — use whichever sheet the counter hands you). The deed that follows is stricter: two witnesses, the FIRST qualifying under paragraph 127, Punjab Registration Manual (a councillor, gazetted officer or advocate; or rurally a Lambardar/Sarpanch/Panch), known to the Sub-Registrar. Don't assume your indemnity-bond witnesses qualify here — usually they won't.
