When you need it

Borrow against gold or a vehicle by handing it to the lender to hold until the loan is repaid. The lender keeps the item; you get it back when you repay. If you do not repay, the lender may sell it after giving you written notice, keep what is owed and return the surplus.

The item is chosen in the questions. For gold you describe each piece with its weight and purity; for a vehicle you give the registration number, chassis and engine numbers, and the lender takes the vehicle and its papers. The agreement then covers where the item is kept, insurance, that the lender may not use or re-pledge it, how you get it back, and what happens on default. This is a pledge, where the lender HOLDS the item. If you keep the item and only give the lender a charge over it, use the Hypothecation Agreement instead. Not for property, which needs a mortgage; not for a loan from a bank, NBFC or gold-loan company, which use their own forms; and not a substitute for the Loan Agreement if you also want repayment terms spelled out in full.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

A pledge agreement is stamped under the entry that applies to it in each jurisdiction, and the figure may depend on the amount of the loan. This drafter could not confirm the entry or the figure against a dated, notified source and does not state them. PUNJAB: confirm with the Sub-Registrar of the tehsil, or against revenue.punjab.gov.in, before the stamp is bought, and e-stamp through the Stock Holding Corporation of India Limited (SHCIL). CHANDIGARH: confirm against revenue.chd.gov.in or with the Sub-Registrar, 30 Bays Building, Sector 17. BOTH: an instrument that is unstamped or insufficiently stamped is inadmissible in evidence under s.35 of the Indian Stamp Act, 1899 until the deficiency and any penalty are paid — which for a security document means the Lender cannot rely on it in the one situation it exists for.

Registration

Not compulsorily registrable where only movable property (gold or a vehicle) is pledged and no interest in immovable property is created. Whether the pledge of a vehicle should be noted with the registering authority is a separate question; see the note for a lawyer.

Notarisation

Not legally required, but useful: it fixes the date on which the item was handed over and the weights and details recorded in the schedule, which is what a later dispute turns on.

Witnesses

Not legally required. Two independent witnesses are taken, as on the other loan documents in this library, and should see the item weighed or inspected and handed over.

A. At the Borrower's request, the Lender has agreed to lend the Borrower ₹1,50,000 (Rupees One Lakh Fifty Thousand only) (the "Loan Amount"). No interest is payable on the loan.

NOW THIS AGREEMENT WITNESSES AND THE PARTIES AGREE as follows:

  1. 1. THE PLEDGE

1.1 The Borrower pledges the Pledged Item to the Lender as security for repayment of the Loan Amount, any interest, and the reasonable costs of keeping and, if needed, selling the Pledged Item (together, the "Secured Amount").

  1. 2. REPAYMENT

2.1 The Borrower shall repay the Loan Amount, with interest if payable under Recital A, on or before 1 April 2026.

2.2 Every payment shall be acknowledged by the Lender in writing.

  1. 3. CUSTODY OF THE PLEDGED ITEM

3.1 The Lender shall keep the Pledged Item at House No. 1451, Sector 33-D, Chandigarh 160020 and shall not move it elsewhere without the Borrower's written consent.

3.2 The Lender shall not use, wear, drive, lend, pledge, sell or otherwise deal with the Pledged Item, except as clause 5 allows after a default.

3.3 The Lender shall keep the Pledged Item insured against theft and loss while it is in the Lender's custody, at the Borrower's cost.

3.4 The Lender shall tell the Borrower promptly in writing if the Pledged Item is lost, stolen or damaged.

  1. 4. GETTING THE PLEDGED ITEM BACK

4.1 When the Borrower has paid the Secured Amount in full, the Lender shall return the Pledged Item to the Borrower in the same condition as received, fair wear aside, together with everything handed over with it, promptly and within three days.
