Prints TWO instruments: the complaint (signed, verified, no duty, plain paper) and a separate AFFIDAVIT after the Schedule, sworn before a Consular Officer/Notary/Oath Commissioner — chargeable under Article 4, Schedule I-A. Section 175(3), BNSS requires this affidavit if you later approach a Magistrate for a non-registered FIR — file without it and you're empty-handed there. The NRI Wing: ADGP, Phase-7, SAS Nagar, STATE-WIDE jurisdiction (0172-2260042/43, pgd.punjabpolice.gov.in). Send a copy to a named Station House Officer too — s.173(1) casts the FIR duty on an officer IN CHARGE OF A POLICE STATION, not the ADGP (supervisory); both letters must go out the same day. This is a request for a criminal case, NOT title recovery or a sale freeze — cancelling a forged instrument needs a civil suit (ss.31-34, Specific Relief Act; three years/twelve years, Articles 59/65). The real freeze is a civil injunction, NOT a police attachment (s.107, BNSS attaches crime proceeds, not your own land). The revenue entry is fixed on a third track (ss.34-37, Land Revenue Act) — run all three together. Other routes not to confuse with this: the NRI Commission (recommendation only); NRI Sabha Punjab (no statutory power). NOT FOR: Chandigarh property (no NRI Wing there); property outside Punjab; a civil dispute in criminal clothing (boundary quarrels, accepted partitions, unpaid instalments); a tenant who won't vacate; your own attorney exceeding a genuine power (a revocation case, not forgery); wanting only the revenue entry fixed (use mutation/Fard Badar); agricultural land bought (not inherited) as an NRI/OCI (RBI-barred); or naming people on suspicion alone (itself an offence under the Bharatiya Nyaya Sanhita).

What follows is written for Punjab. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

The complaint: NIL duty, plain paper. The affidavit: chargeable, Article 4, Schedule I-A — buy the e-stamp via SHCIL, take the duty the portal displays (every online Article 4 figure elsewhere is unsourced). Signed abroad: three months from first receipt in India to stamp (s.18) or it's inadmissible (s.35) — a live risk since the investigating officer and any s.175(3) Magistrate rely on it. One fact belongs IN the complaint: since 15 Jan 2024, a sale-authorising POA to anyone outside the family (spouse/child/parent/sibling/grandparent/grandchild) is 2% of consideration/Collector rate (Article 48(f), 2023 Amendment) — no honest way to nominally stamp one after that date. If the forged power is dated on/after 15.1.2024 with a nominal stamp favouring an outsider, say so: it's under-stamped as well as forged, checkable against SHCIL's purchase record. Chandigarh is outside this template's reach — no NRI Wing exists there.

Registration

None — neither document is listed under s.17; no Sub-Registrar involved. Registration matters as EVIDENCE of the crime. Ask for: certified copies (s.57) — but a POA sits in Book 4, restricted to executants/agents (s.57(5)), unlike a sale deed's Book 1 — send your representative with written authority naming the vasika number, or leave it to the investigating officer. The section 32A record: photo/fingerprints of whoever actually presented the forged document — often not you, four thousand miles away — ask the officer to obtain and compare against your own passport photo. The e-stamp trail on the impugned deed. Suraj Lamp v. State of Haryana (2011): SA/GPA/WILL transfers convey no title. G. Kalawathi Bai v. G. Shashikala, 2025 INSC 851 (15.7.2025): s.32(c)/33 authentication required even where the attorney both executes and presents — an unauthenticated power on record is a defect worth pleading. The revenue track runs in parallel (ss.34-37, Land Revenue Act, Tehsildar to Financial Commissioner).

Notarisation

The complaint needs none — the verification signature suffices. The AFFIDAVIT is sworn before the Indian Embassy/Consulate (safest abroad) or, strictly, a Notary Public plus apostille (India, Hague party since 2005) — though Punjab offices often still want consular attestation. In Punjab: a Notaries Act notary or Oath Commissioner — get the register serial number on the jurat. Stamp within three months of first receipt (see stamping note). Court fees: none on the complaint/affidavit. They arise only on escalation — s.173(4), BNSS (free, to the SP) then, if that fails, the s.175(3) Magistrate application (a court filing, fee shown on the SHCIL portal for the court/filing type selected).

Witnesses

No attesting witnesses on either instrument — the affidavit's Consular/Notary/Oath Commissioner attestation replaces a witness. Name FACT witnesses instead: the Halqa Patwari/Field Kanungo who made the false entries; the Lambardar/Sarpanch; neighbouring khewat-holders; the tenant or siri who paid you; Sub-Registrar staff who identified the executant (s.34); and the impugned deed's OWN marginal witnesses — often paid to sign unread, usually first to tell the truth. Prove two deliveries: the complaint to the addressed office, and the copy to the named SHO — stamped, dated, diary-numbered receipts for both, or registered post if refused. Once an FIR registers, s.173(2), BNSS entitles you to a free copy forthwith.

  1. WHO I AM

1.1 I am Jasvir Singh Bains, son of Late Sardar Mohinder Singh Bains. I am a Non-Resident Indian holding an Indian passport, and I ordinarily reside at 14 Ashcroft Avenue, Southall, Middlesex UB1 2LR, United Kingdom, United Kingdom.

1.2 My address in India is Bains Kothi, Ward No. 4, Village Bilga, Tehsil Phillaur, District Jalandhar, Punjab 144026. My passport or Overseas Citizen of India card bears number Z4183926, and a self-attested copy of it is annexed to this complaint.

1.3 I can be reached at +44 7700 900412 and at jasvir.bains@example.co.uk. Because of the difference in time zones I request that email be treated as the primary channel of communication with me, and that nothing be dispatched to my Indian address alone, since that address is not occupied throughout the year. 1.4 I am making this complaint from outside India and I do not propose to travel to Punjab merely in order to lodge it. I request that it be received, registered and acted upon in this form. It is supported by my affidavit, sworn and attested, which is printed after the Schedule below and annexed to it. My statement can be recorded by audio-video electronic means, which section 530 of the Bharatiya Nagarik Suraksha Sanhita, 2023 expressly permits for the examination of a complainant and of witnesses, and I will make myself available at whatever hour is convenient to the investigating officer.

1.5 Harpreet Singh Bains, my younger brother, resident at House No. 212, Model Town, Phillaur, District Jalandhar, Punjab 144410, mobile +91 XXXXX XXXXX, is authorised by me to present this complaint, to receive documents and communications on my behalf, and to attend before the investigating officer. That authority is for presentation, receipt and attendance only. It is not an authority to compromise this complaint, to withdraw it, to record any statement of settlement, or to deal with the property in any manner whatsoever, and no statement to any such effect should be accepted from that person without my own written confirmation sent from the email address given above.

  1. THE PROPERTY

2.1 This complaint concerns agricultural land situated in the revenue estate of Bilga (Hadbast No. 271), Tehsil Phillaur, District Jalandhar, Punjab, fully described in the Schedule at the foot of this complaint ("the Property").

2.2 The Property is mine. I have never sold it, gifted it, exchanged it, relinquished it, mortgaged it, agreed to sell it, or authorised any person to do any of those things on my behalf.

  1. HOW I HOLD THE PROPERTY

3.1 I acquired the Property by inheritance on the death of my father.

3.2 The documents and entries which establish my title are:

  1. Mutation of inheritance No. 3418 sanctioned by the Naib Tehsildar, Phillaur on 12.08.2009 on the death of my father Sardar Mohinder Singh Bains on 04.03.2009.
  2. Death certificate of Sardar Mohinder Singh Bains, registration No. 214/2009, Municipal Council Phillaur.
  3. Jamabandi for the year 2021-22, revenue estate Bilga, in which my name stands recorded as owner to the extent of a 1/3rd share.
  4. Fard Jamabandi obtained from the Fard Kendra, Tehsil Phillaur on 22.02.2024.

3.3 As to possession: I was in physical possession of the Property, myself or through my family.

3.4 As to my capacity to hold the Property while resident outside India: I acquired the Property by inheritance, and a person resident outside India may acquire any immovable property in India, including agricultural land, by inheritance under the Foreign Exchange Management Act, 1999 and the Foreign Exchange Management (Non-debt Instruments) Rules, 2019 dated 17 October 2019.

  1. WHAT I COMPLAIN OF

4.1 I complain of a forged power of attorney used to deal with my property. The property affected is the Property described in the Schedule below.

4.2 The facts are these:

I have lived in the United Kingdom since 1998 and last visited Punjab in November 2019. On 24 February 2026 I obtained a copy of the jamabandi and found that a sale deed dated 11 June 2024 had been registered in the office of the Sub-Registrar, Phillaur, purporting to be executed by an attorney acting under a power of attorney said to have been given by me on 3 April 2024 at London. I have never executed any such power of attorney. I have never met or instructed the person named in it as my attorney. My signature and photograph on the document, as they appear in the copy I have seen, are not mine. I was in the United Kingdom throughout April and June 2024 and did not travel to India in either month, as my passport shows. The sale consideration recited in the deed has never reached me in any form, and I hold no bank account into which it could have been paid.

The instrument or act complained of bears the date 1 April 2026 on its face. I say that I neither executed nor authorised anything on that date, that any signature, photograph or thumb impression attributed to me is fabricated, and that I was not in India, or not at the place named, on that date. My passport and the immigration endorsements in it will establish where I in fact was, and I annexe the relevant pages.

The particulars of the impugned document, so far as I have been able to obtain them from abroad, are:

Sale deed bearing Vasika No. 4127, registered on 11 June 2024 in the office of the Joint Sub-Registrar, Phillaur, District Jalandhar; consideration recited as Rs. 18,00,000; e-stamp certificate No. IN-PB63482917446215X of Rs. 90,000 dated 6 June 2024; executed by one Sukhdev Singh describing himself as my attorney under an unregistered power of attorney said to be dated 3 April 2024; purchaser shown as Ranjit Kumar; marginal witnesses shown as Karam Chand and Balwinder Singh.

  1. HOW I CAME TO KNOW OF IT

5.1 I first came to know of the matters set out above on 2 April 2026.

5.2 The circumstances in which I came to know of them were:

On 19 February 2026 my cousin Baljit Singh, who lives in the village, telephoned me to say that a boundary wall was being raised on my share of the land. I asked him to obtain a fard. On 24 February 2026 he sent me a photograph of the jamabandi for 2021-22 with a mutation entry showing the land as sold. Until that day I had no knowledge whatever of any sale, any power of attorney, or any mutation.

5.3 I state the date of knowledge plainly because it matters beyond this complaint. Article 59 of the Limitation Act, 1963 allows three years from the date on which the facts entitling a person to have an instrument set aside first become known to him, and Article 65 allows twelve years for a suit for possession founded on title. I put the date on the record from the first day so that there can be no later argument about it.

  1. THE PERSONS I ACCUSE

6.1 I name the following persons, with such particulars as I presently have:

  1. Sukhdev Singh son of Bakhshish Singh, resident of Village Bilga, Tehsil Phillaur — described himself as my attorney and executed the sale deed dated 11 June 2024.
  2. Ranjit Kumar son of Om Parkash, resident of Mohalla Shastri Nagar, Phillaur — shown as the purchaser and now in occupation.
  3. Karam Chand son of Ram Lal, resident of Village Bilga — signed as marginal witness.
  4. The unknown person who impersonated me before the Joint Sub-Registrar, Phillaur, whose photograph and thumb impression will be on the registration record, and whom I ask to be identified and arrested.

6.2 I do not know how many others were concerned in these acts, and I do not name anyone on suspicion. I say only this: on the face of it the acts complained of could not have been carried through by the persons named alone. They required at the least a person who impersonated me, persons who identified that impersonator before the registering officer, and persons who signed as marginal witnesses. I request that the investigation extend to each of them, and to any public servant who assisted, and I ask that nobody be left out on the footing that this is a family matter.

  1. THE POSITION ON THE GROUND TODAY

7.1 As matters stand, the accused are in physical occupation of the Property.

7.2 Taking the Collector rate for the revenue estate, as published by the Deputy Commissioner of the district, as the measure, the value at stake and the loss to me is of the order of Rs. 96,00,000. I do not put that figure forward as a valuation for any other purpose. I put it forward so that the gravity of the offence, and the urgency of tracing and securing the money said to have changed hands, are not mistaken.

  1. THE OFFENCES I SAY ARE DISCLOSED

8.1 I am not a lawyer and I do not ask that this list bind the investigating officer, who will apply his own mind to the facts. I set it out so that the complaint is not returned to me for want of a section.

(a) Forgery — section 336 of the Bharatiya Nyaya Sanhita, 2023: making a false document with intent to cause damage or injury, to support a claim or title, or to cause a person to part with property. Where the forgery is committed for the purpose of cheating, section 336(3) provides imprisonment which may extend to seven years, and fine, and it is that sub-section on which I rely.
