ਕਦੋਂ ਲੋੜ ਪੈਂਦੀ ਹੈ

You live abroad and will sign a document (most often a power of attorney, but also an affidavit or a consent letter) for use at an office in Punjab or Chandigarh, and want a working list of the steps and papers so that it is not turned away at the counter. The list follows two routes: a country that is a party to the Apostille Convention, where the usual step is an apostille issued in that country; and a country that is not, where the document is attested in steps and ends with the Indian Embassy, High Commission or Consulate.

Offices change them, so the list tells you to ask. It does not say whether your country is a party to the Convention; you tell it. ਹੇਠਾਂ ਜੋ ਲਿਖਿਆ ਹੈ ਉਹ ਪੰਜਾਬ ਅਤੇ ਚੰਡੀਗੜ੍ਹ ਲਈ ਹੈ। ਇਸ ਵਿੱਚ ਉੱਥੋਂ ਦੀ ਹੀ ਸਥਿਤੀ ਦਿੱਤੀ ਗਈ ਹੈ, ਇਹ ਨਹੀਂ ਕਿ ਇਹ ਕਿੱਥੇ-ਕਿੱਥੇ ਕਿਵੇਂ ਬਦਲਦੀ ਹੈ — ਭਾਵ ਹੇਠਲੀਆਂ ਰਕਮਾਂ ਉਹੀ ਹਨ ਜੋ ਲਾਗੂ ਹੁੰਦੀਆਂ ਹਨ। ਦਰਾਂ ਬਦਲਦੀਆਂ ਰਹਿੰਦੀਆਂ ਹਨ, ਇਸ ਲਈ ਸਬ-ਰਜਿਸਟਰਾਰ ਦਫ਼ਤਰ ਤੋਂ ਪੱਕਾ ਕਰ ਲੈਣਾ ਠੀਕ ਰਹਿੰਦਾ ਹੈ। ਜੇ ਪ੍ਰਾਪਰਟੀ ਭਾਰਤ ਵਿੱਚ ਕਿਤੇ ਹੋਰ ਹੈ, ਤਾਂ ਇਸ ਵਿੱਚੋਂ ਕੁਝ ਵੀ ਤੁਹਾਡੇ ਲਈ ਨਹੀਂ ਹੈ।

ਸਟਾਂਪ ਡਿਊਟੀ

ਇਹ ਜਾਂਚ-ਸੂਚੀ ਸਟੈਂਪ ਡਿਊਟੀ ਯੋਗ ਲਿਖਤ ਨਹੀਂ ਹੈ। ਜਿਸ ਦਸਤਾਵੇਜ਼ ਦਾ ਇਸ ਵਿੱਚ ਵਰਣਨ ਹੈ, ਉਸ ਉਤੇ ਭਾਰਤ ਵਿੱਚ ਸਟੈਂਪ ਲਗਵਾਉਣਾ ਪੈ ਸਕਦਾ ਹੈ, ਅਕਸਰ ਉਸਦੇ ਪਹਿਲੀ ਵਾਰ ਭਾਰਤ ਪਹੁੰਚਣ ਤੋਂ ਬਾਅਦ ਇੱਕ ਨਿਸ਼ਚਿਤ ਮਿਆਦ ਦੇ ਅੰਦਰ; ਜਿੱਥੇ ਵਰਤੋਂ ਹੋਵੇਗੀ ਉਸ ਦਫ਼ਤਰ ਤੋਂ ਪੁੱਛ ਲਓ।

ਰਜਿਸਟਰੀ

ਇਹ ਜਾਂਚ-ਸੂਚੀ ਰਜਿਸਟਰ ਕਰਨ ਯੋਗ ਨਹੀਂ ਹੈ। ਤਸਦੀਕਸ਼ੁਦਾ ਦਸਤਾਵੇਜ਼ ਦੀ ਭਾਰਤ ਵਿੱਚ ਰਜਿਸਟਰੀ ਜ਼ਰੂਰੀ ਹੈ ਜਾਂ ਨਹੀਂ, ਇਹ ਇਸ ਉਤੇ ਨਿਰਭਰ ਹੈ ਕਿ ਉਹ ਕੀ ਹੈ; ਜਿੱਥੇ ਵਰਤੋਂ ਹੋਵੇਗੀ ਉਸ ਦਫ਼ਤਰ ਤੋਂ ਪੁੱਛ ਲਓ।

This list gives the usual steps. Offices change their rules, fees and appointment systems, so ask each office what it needs on the day.

Part 1. Before you sign

1. Have the document prepared with every name, spelling and number exactly as in your passport and your Indian papers (Aadhaar, PAN, land records).
2. Ask the office in Punjab or Chandigarh where it will be used (the Sub-Registrar, bank, court or other) whether it wants particular wording or its own form. Prepare the document to match.
3. Do not sign at home. Sign only in front of the notary, and sign every page the notary asks you to.

Part 2. Signing before a notary

4. Sign before a Notary Public in Australia. Take your passport and any other identity the notary asks for.
5. Ask the notary for the notarial certificate to be on the document itself or firmly attached to it.
6. If you can sign before the Indian Embassy, High Commission or Consulate for your area, ask that office whether the document then needs any further step.

Part 3. Your country is a party to the Apostille Convention

7. In this case the usual route is a single certificate, called an apostille, issued in Australia. It replaces the Embassy attestation. The office that issues it is the Department of Foreign Affairs and Trade.
8. Some countries need a step before the apostille, for example registering the notary's signature with another office. Ask the apostille office what it requires.
9. Keep the apostille attached to the document. Do not remove staples or seals.
10. Ask the office in Punjab or Chandigarh whether it accepts an apostille alone. Some offices ask for attestation by the Indian Mission as well.

Part 4. Papers to send with the document

11. A copy of your passport and, if you hold one, your OCI card.
12. Proof of your address abroad, if the office asks for it.
13. Any covering form or application the attesting office asks for.
14. A photocopy of the whole attested document for your own records.

Part 5. Bringing it to India

15. Courier the original with tracking. Note the date it first reaches India.
16. Ask the Sub-Registrar or other office whether the document must be stamped within a fixed time after it reaches India, and do it within that time.
17. If it is a power of attorney, the person holding it should take the original to the office. Ask whether it must be registered or further authenticated before it is used.
18. Keep copies of everything, and the courier receipt.
