When you need it

A business in Punjab or Chandigarh that owns a trademark (a brand name, logo or label) needs one of three papers. You choose which in the questions, and the document prints only that one. The first lets another person use the mark, or act for the owner in dealing with the Trade Marks Registry, on stated terms.

The second is the owner's own affidavit swearing how long and how the mark has been used, which the Registry or a court may ask for to support an application or an opposition. The third is a notice to someone using the same or a confusingly similar mark, asking them to stop. The Registry has its own prescribed forms for applications, for appointing an agent and for other steps (the form numbers and fees change). These papers are the owner's own supporting letter, affidavit and notice; they are not copies of any form, and the prescribed form may still have to be filed. The affidavit must be true: a false statement of use can lose the owner the mark and carry penalties. Not for filing the application for registration itself. Not for assigning the mark to someone else (use the Copyright / IP Assignment). Not for a general legal notice on money (use the Legal Notice for Recovery of Money).

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

It depends on the paper chosen. An authorisation letter and a notice carry no stamp duty by themselves, though a licence of the mark for a fee on stated terms may be charged as an agreement. An affidavit is printed on stamp paper of a small fixed value; no Punjab or Chandigarh table consulted for this document lists the exact figure, so ask the stamp vendor, the e-stamping portal or the notary.

Registration

Not registrable. Any filing with the Trade Marks Registry is made separately, in the Registry’s own prescribed form.

Notarisation

An affidavit must be sworn before a Notary Public or an Oath Commissioner. An authorisation letter and a notice need no notary; for a notice, keep proof of sending and delivery.

Witnesses

No witnesses are needed.
