When you need it

When a bank is selling a mortgaged property by auction and you want to bid. You write to the bank's authorised officer with your bid, the earnest money deposit (EMD) you have paid, your identity and PAN, and confirm that you have read the sale notice and buy the property on the terms it states.

For an online auction the bid itself is placed on the portal; this letter goes with the EMD and your papers. It does not make you the buyer: the bank accepts the highest bid under its notice, and the sale certificate comes later. Not for a court auction or a private sale (use the Agreement to Sell), and it is not a substitute for the sale certificate you receive after the price is paid.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

No stamp duty is payable on this application. Ask the office whether it wants a fee or a court-fee label on it.

Registration

Not registrable; it is an application, not an instrument.

Notarisation

Not required, unless the sale notice asks for an affidavit or declaration; follow the notice.
