Why you need it

When you need it

A commercial-leasing broker in Punjab or Chandigarh, billing the landlord or the tenant — whichever owes the fee under the brokerage agreement — for commission earned on one completed lease. Names the premises and the Lease Deed or Lease Agreement it relates to, states the commission basis, and once the fee is paid doubles as the signed acknowledgement of the paying party that the amount is received and the mandate of the Broker for that Lease is discharged. A broker registered for goods and services tax issues it as a tax invoice; the place of supply is where the Premises are — Punjab charges central tax plus state tax, Chandigarh charges central tax plus Union territory tax. It does not replace the brokerage agreement that fixes the fee in the first place.

Unpaid, this document is only an invoice and attracts no stamp duty. Once the acknowledgement of payment is completed and signed, it becomes a receipt for money under Article 53, Schedule I of the Indian Stamp Act, 1899 as applicable in Punjab and in Chandigarh: for a sum exceeding Rs 5,000, a revenue stamp of one rupee is affixed over the signature of the paying party and cancelled by that signature. The discharge language does not turn the document into a release or into an instrument chargeable under any other Article — in substance it remains a receipt for the sum stated, and no ad valorem duty is payable on the commission itself.

Registration
