कब ज़रूरत पड़ती है

Many commercial leases in Punjab and Chandigarh do not start rent on the day the lease is signed. The landlord hands the premises over, and the tenant gets a fit-out period, often rent-free, to build counters, partitions, kitchens or fixtures before opening.

The lease may say that rent starts "after the fit-out period" or "on opening", but nobody writes down the actual date. Months later the two sides argue over which day the first rent fell due, and from which day CAM and the lock-in run. This letter fixes those dates in writing once they are known: the date the premises were handed over, the fit-out period (if any), the date rent starts, the rent and charges from that date, and what happens to rent for a part month at the start. The landlord signs it and the tenant countersigns to confirm. Use it when the lease provides for a handover or fit-out period and possession has now been given or the fit-out has now ended. Not for: changing the rent, the term or the lock-in (that is an amendment to the lease and should be done as a lease addendum), or recording the handover condition of the premises, for which a separate handover memo with a snag list is the right paper.

If the letter changes what the lease says (for example it moves the date from which the term runs, or gives extra rent-free days not in the lease), it may be treated as an amendment to the lease and charged duty accordingly. Check the current figure with the Sub-Registrar or a licensed stamp vendor; this letter does not state one.

रजिस्ट्री

Nothing in this letter needs registration if it only confirms dates under the lease. If the lease is registered and this letter changes its terms, a lawyer should say whether the change itself needs to be registered.

नोटरी

Not required. Both signatures with dates are enough.

गवाह

Not required. The dates each side writes beside its signature matter more than a witness.

RENT COMMENCEMENT DATE LETTER

Chadha Commercial Complex Private Limited, an individual, of SCO 11, Sector 8-C, Chandigarh 160009, acting through Ravneet Chadha, Director

To (the "Tenant"):
Chopra Footwear Private Limited, an individual, of SCO 11, Sector 8-C, Chandigarh 160009, acting through Ravneet Chadha, Director

Subject: Rent commencement date for the premises at Shop No. 3, Ground Floor, SCO 11, Sector 8-C, Chandigarh, Chandigarh

  1. 1. The Tenant occupies the premises known as Shop No. 3, Ground Floor, SCO 11, Sector 8-C, Chandigarh, situated at Chandigarh, in the State of Punjab (the "Premises"), under a Lease Deed dated 2 January 2026 between the Landlord and the Tenant for a term of 9 years commencing 1 February 2026 (the "Lease").
  1. 2. The Landlord handed over possession of the Premises to the Tenant on 1 April 2026.
  1. 3. The Tenant was given a fit-out period of 60 days from that date, during which the Tenant fitted out the Premises for its business.
  1. 4. As provided by the Lease, rent starts on the date of handing over of possession. The Landlord and the Tenant agree and confirm that rent commences on 2 April 2026 (the "Rent Commencement Date").
  1. 5. From the Rent Commencement Date the Tenant shall pay rent of ₹1,20,000 (Rupees One Lakh Twenty Thousand only) per month, by the 7 day of each month, as the Lease provides.
  1. 6. From the same date the Tenant shall also pay the CAM or maintenance charge of ₹15,000 (Rupees Fifteen Thousand only) per month, with the rent.
  1. 7. Rent for any part of a month at the start is charged for the actual days, on a daily basis.
  1. 8. The term of the Lease, the lock-in period and every other date in the Lease are not changed by this letter.
  1. 9. The lock-in period ends on 2 April 2026.
  1. 10. The Lease ends on 3 April 2026, unless renewed or ended earlier under its terms.
  1. 11. Except for the dates stated in this letter, the Lease continues on its own terms. This letter does not change the amount of rent, the security deposit or any other term of the Lease, and it does not waive any right of either side under the Lease.
  1. 12. The Tenant confirms the dates above by countersigning this letter. If the Tenant does not agree with a date, it shall say so in writing within 7 days of receiving this letter.
