Subject: Notice for refund of 6 lakh rupees paid for a Canada work visa not delivered
Sir or Madam,
- 1. What you promised. On 10 January 2026 the agent promised a work visa for Canada within six months, a job offer and air tickets, for the fee stated below. As to your licence or registration: a licence shown on the office wall, number not noted.
- 2. What I paid. 2 lakh rupees by bank transfer on 12 January 2026, 3 lakh rupees by cheque on 3 March 2026, and 1 lakh rupees in cash on 20 April 2026 against a handwritten receipt. The total I paid is ₹6,00,000 (Rupees Six Lakh only).
- 3. What you did. No visa was issued. The agent gave different excuses, stopped answering calls from 15 September 2026, and the office was found shut on 2 October 2026.
- 4. Why this is a wrong. You took money for a service and did not provide it, and have not returned the money. That is a deficiency in service and an unfair trade practice, and, if you never meant to perform, it may be cheating.
- 5. What I require. Within fifteen days of receiving this notice, refund the whole amount I paid, in one payment. Please pay by transfer to the savings account of the sender with Punjab National Bank, Urban Estate branch, Patiala, the details of which I will give on request, or by demand draft payable to the sender.
- 6. If you do not. If you do not do this within fifteen days, I will, without further notice, file a consumer complaint before the District Consumer Commission, complain to the authority that licenses travel agents and consultants, and report the matter to the police for cheating, and I will ask for refund, interest, compensation and costs. I may also take the civil court route. This notice does not waive any of my rights, and it does not stop any of them.
- 7. Keep the evidence. Please keep safe your records of my file, the receipts, the messages and any application or document you prepared for me, and do not alter or destroy them.
ENCLOSURES
- 1. Receipts and bank records of the payments. 2. Messages and emails with the agent. 3. Visiting card and any agreement.
LEGAL BASIS
Punjab and Chandigarh: Taking money for a service and not providing it is a deficiency in service under the Consumer Protection Act, 2019, and the District Commission, on a complaint made within two years of the cause of action, can order refund, compensation and costs. Dishonest inducement to part with money may be cheating under the Bharatiya Nyaya Sanhita, 2023. In Punjab the Punjab Travel Professionals Regulation Act, 2012 regulates travel agents and immigration consultants, who must hold a licence, and makes certain acts offences; recruitment for overseas employment is also governed by the Emigration Act, 1983. Which authority in Punjab or Chandigarh licenses the agent is to be confirmed. No fee is payable on this notice.
