When you need it

A civil suit to recover a fixed sum of money that the defendant owes under something in writing: a loan agreement, a promissory note or hundi, a written contract for goods or services, or a guarantee. It is drafted as a summary suit under Order XXXVII of the Code of Civil Procedure, 1908, which is meant for exactly this kind of claim: the defendant cannot simply deny and delay, and must get the court's leave to defend.

A summary suit must be on a written document and must claim only money. Court papers are usually filed through an advocate, who also files a vakalatnama; this form prepares the draft for them to settle. The court fee depends on the amount claimed and was not confirmed here; ask the filing counter. Not for: a debt with nothing in writing, a claim for something other than money, or a first demand (send the Recovery Notice in this library before you sue). For a dishonoured cheque, see the Cheque Bounce Complaint.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

No stamp-paper duty is payable on the pleading itself; it bears the court's own court-fee stamp. The court-fee figure for this kind of filing in Punjab and in Chandigarh was not confirmed here: ask the court's filing counter (Nazarat) or your advocate for the amount on your valuation, and for the vakalatnama stamps if an advocate is engaged.

Registration

Not registrable: a court paper is not an instrument under section 17 of the Registration Act, 1908. Any decree that results has its own registration or mutation step, if one is needed.

Notarisation

The paper is verified by the party and signed; it is not notarised. Any separate affidavit filed with it (the General Court Affidavit in this library will do) is sworn before an Oath Commissioner or Notary.

Witnesses

None required for the paper itself. Evidence is led later, in the court's own procedure.

versus

Jaswinder Singh, S/o Sh. Gurdev Singh, aged 47 years, businessman, resident of House No. 9, Sector 21-C, Chandigarh ... Defendant

The plaintiff states as follows:

  1. 1. SUMMARY SUIT. This suit is filed under Order XXXVII of the Code of Civil Procedure, 1908. The plaintiff claims no relief outside the scope of that Order. The claim is a debt, or a liquidated demand in money, arising on a written loan agreement or written acknowledgement of the loan.
  1. 2. THE DEBT. By a written loan agreement or written acknowledgement of the loan dated 1 April 2026 (signed by the defendant before two witnesses, for a loan of Rs. 4,00,000 repayable by 31.12.2025 with interest at 12 per cent a year), the defendant became liable to pay the plaintiff ₹4,00,000 (Rupees Four Lakh only). Interest of ₹48,000 (Rupees Forty Eight Thousand only) has accrued up to the date of filing (12 per cent a year from 01.01.2026 to 30.09.2026). The defendant has made these part payments: Rs. 50,000 on 10.02.2026. The total now claimed is ₹3,98,000 (Rupees Three Lakh Ninety Eight Thousand only).
  1. 3. DEMAND AND DEFAULT. The money fell due on 2 April 2026. The plaintiff asked for payment on 05.01.2026 and 20.02.2026, and sent a legal notice on 10.04.2026 by registered post. The defendant promised to pay but did not. The defendant has not paid.
  1. 4. JURISDICTION AND VALUATION. The defendant resides, or the cause of action arose, within the territorial limits of this Court. The suit is valued at ₹3,98,000 (Rupees Three Lakh Ninety Eight Thousand only), the amount claimed, for jurisdiction and court fee. Court fee is paid as the court fee table of this Court requires on that valuation.
  1. 5. OTHER PROCEEDINGS. No other suit or proceeding between the parties on the same matter has been filed or decided.
  1. 6. DOCUMENTS. The plaintiff relies on: Original loan agreement dated 01.07.2025; bank statement showing transfer of Rs. 4,00,000; legal notice dated 10.04.2026 with postal receipt..

PRAYER

The plaintiff prays for: (a) a decree for ₹3,98,000 (Rupees Three Lakh Ninety Eight Thousand only) against the defendant; (b) interest on that sum from the date of the suit until payment, at the rate the Court thinks fit; and (c) the costs of the suit.

VERIFICATION

Verified at S.A.S. Nagar (Mohali) on 3 April 2026 that paragraphs 1 to 4 are true to my knowledge and paragraphs 5 to 6 are true on the records and on information I believe to be true; nothing material has been concealed.

Plaintiff: Harpreet Singh
