When you need it

You are a builder or promoter and a buyer's instalment has fallen due under the payment plan in the agreement, or has been missed. This letter states which stage or date the demand relates to, the amount due, the last date for paying, how to pay, and what you will do if it is still unpaid, which is to send a further notice as the agreement and the real estate law require, not to cancel at once.

Raise the demand only for a stage that has actually been reached under the agreement, and keep proof of delivery. If the buyer stays in default, a separate cancellation notice follows. Not for cancelling the allotment — use the Builder's Cancellation Notice to a Defaulting Buyer. Not for offering possession — use the Possession Offer Letter and Handover Checklist.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.
