When you need it

A residential flat or plot booking has been, or is being, cancelled — because the promoter delayed possession, because the allottee is withdrawing from the project for another reason, or because the promoter itself failed to perform — and you want a formal, dated demand for the refund of everything paid, stating the deductions (if any) the promoter is entitled to make and the interest claimed on a delayed refund. Where the cancellation follows a possession delay actionable under section 18 of the Real Estate (Regulation and Development) Act, 2016, this letter states that position; where it is a plain voluntary cancellation by the allottee for another reason, it instead works from the cancellation clause in the Agreement for Sale/Builder-Buyer Agreement, which can allow the promoter to deduct a forfeiture — itself limited to reasonable compensation under section 74 of the Indian Contract Act, 1872, not an automatic penalty.

Dear Sir/Madam,

  1. 1. I/We booked Flat No. 1204, Tower C in your project "Northland Greens, Sector 82", under An Allotment Letter only — no Builder-Buyer Agreement was yet executed dated 2 April 2026.
  1. 2. I/We have paid you a total of ₹12,00,000 (Rupees Twelve Lakh only), particulars: Rs 6,50,000 on booking (12 March 2025); Rs 5,50,000 on execution of the Builder-Buyer Agreement (18 April 2025).
  1. 3. This booking is cancelled/withdrawn on the following basis: Withdrawal under section 18 of the Real Estate (Regulation and Development) Act, 2016, on account of the promoter's delay in handing over possession

Possession was promised by 30 June 2025 and has not been handed over as of this date, a delay of over a year.

  1. 4. Deductions, if any: None — the entire amount paid is refundable without deduction, this being a withdrawal under section 18 of the Real Estate (Regulation and Development) Act, 2016
  1. 5. Net refund demanded (before interest): ₹12,00,000 (Rupees Twelve Lakh only).
  1. 6. Interest claimed: At the rate prescribed under the relevant State RERA Rules for a refund following a section 18 withdrawal, from the date of each payment until refund.
  1. 7. Kindly remit the amount due within 30 days of receipt of this letter, as follows: By RTGS/NEFT to: [bank name, account number, IFSC, account holder name].
  1. 8. Failing compliance within that period, I/we shall be constrained to approach the Real Estate Regulatory Authority and/or the appropriate consumer forum/court, at S.A.S. Nagar (Mohali), for recovery with interest and costs, at your risk and consequence.
