When you need it

A sworn family tree (kursinama) of a deceased person — on stamp paper and notarised, sworn by a family member who knows the family. It names the parents, spouse and children of the deceased, and further generations if you need them, saying for each whether the person is living or deceased.

Offices in Punjab and Chandigarh often ask for it with a mutation, a bank or insurance claim, a pension claim or a legal-heir application. It is evidence for the office, not a finding of who the heirs are; it should not promise that no unknown heir exists anywhere. An unnamed heir is not deprived of rights by being left out. It does not transfer property or replace probate, a succession certificate, a heirship certificate or a release. Not for a statement that there is no other legal heir: use the Affidavit That There Is No Other Legal Heir. Not for a claim to a bank deposit, locker or shares: use that claim's own letter. Chandigarh: Estate Office file; Punjab: local revenue or authority record.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

Fixed Article 4 duty (not a %); authorities print Rs 25 on own forms, but no PB/CH table lists an affidavit rate — confirm at counter. E-stamp in deponent's own name, one sheet each. Chandigarh Estate Office accepts a notarised affidavit over an Executive Magistrate's.

Registration

Not registrable (s.17); does not itself transmit estate property.

Notarisation

Sworn/affirmed before the oath or notarial authority the receiving file accepts.

Witnesses

Not required for the affidavit; the deponent signs after verification. If the receiving office asks for an attesting person (for example a lambardar, sarpanch or municipal councillor), the form has an optional attestation block. Ask the office first.

LEGAL BASIS

Punjab: This affidavit is supporting evidence in the receiving succession/property file and does not itself determine heirship. Article 4 of Schedule I-A is the affidavit stamp classification; the exact Punjab denomination was not confirmed from the sources used. The oath/notarial authority receives the sworn statement, while the substantive succession office/court remains responsible for the underlying claim. No independent appeal route attaches to the affidavit itself.

Chandigarh: The affidavit has the same evidentiary role and Article 4 classification; the exact Chandigarh denomination was not confirmed. For sector/estate property, the substantive transmission is decided in the Estate Office file under the 1952 Act and 2007 Rules, not by this affidavit. No independent appeal route attaches to the affidavit itself.
