When you need it

The two papers that go with RTO Form 31 when the registered owner of a vehicle has died: the affidavit of the heir who is taking the vehicle, and the no-objection of the other legal heirs. Form 31 is the application to the Registering Authority (the RTO) to transfer the registration into the heir's name; this document supplies the sworn statement of the owner's death and of the heirs, and the other heirs' consent, so that the Authority is not left to guess whether anyone else claims the vehicle.

You give the vehicle's registration, make, chassis and engine numbers as they appear on the registration certificate, the registered owner's death details, your relationship, and the other heirs. If there are other adult heirs, you name up to three who sign the no-objection, with two witnesses. Say whether the vehicle is under a loan: if it is, the lender's NOC or hypothecation termination is a separate paper. Papers to attach: Form 31 itself, in the form the RTO prescribes; the original registration certificate; the death certificate; the insurance certificate; your identity and address proofs with the Aadhaar number masked; and whatever else the RTO lists for your case. The RTO's fee and time limits are its own: ask at the counter. Not for a vehicle given in the owner's lifetime (use the Vehicle Gift Affidavit), a lost registration certificate or insurance (use the Duplicate RC or Insurance Affidavit) or the lender's release (use the Vehicle Loan NOC / Hypothecation Termination Letter). For the owner's other property, see Transmission of Property on Intestacy.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

Punjab and Chandigarh: the affidavit carries a fixed, nominal stamp duty, not a percentage, and is made on stamp paper (usually an e-stamp) in the deponent's name. This library does not state the figure for Punjab or Chandigarh, and the RTO may also have its own requirement for the no-objection of the other heirs: confirm both with the RTO counter and the stamp vendor before you buy the stamp paper.

Registration

Punjab and Chandigarh: not registrable. A motor vehicle is movable property, so section 17 of the Registration Act, 1908 does not reach the affidavit or the no-objection. The change of the owner's name is made on the RTO's own register, on Form 31.

Notarisation

Punjab and Chandigarh: the affidavit is sworn before a notary or other oath-taking authority the RTO accepts. The no-objection is signed by each other heir; the RTO may want the signatures attested by a notary or to see the heirs' identity proofs, so ask the counter.

Witnesses

Punjab and Chandigarh: the affidavit needs no witness once it is sworn. The no-objection is signed in front of two witnesses, whose names and addresses are in the document; the RTO may also want to see their identity proofs.

LEGAL BASIS

Punjab: The registration of a motor vehicle on the death of its registered owner is dealt with under the Motor Vehicles Act, 1988 and the Central Motor Vehicles Rules, 1989. The person who acquires the vehicle on the owner's death applies to the Registering Authority on Form 31 to have the registration transferred into their name, and the Authority tells the applicant which papers and fee it needs. This affidavit and the no-objection are supporting papers: they do not themselves decide who inherits the vehicle, which follows the succession law of the owner (for a Hindu, the Hindu Succession Act, 1956; other communities follow their own law). The Registering Authority of the district decides the application, and an applicant who is not satisfied can go to the appellate authority named under the Act or to the Punjab and Haryana High Court. A dispute among the heirs about the vehicle is decided by the civil court.
