When you need it

Use this Deed when one person gives money to a relative as a gift, by cash or by bank transfer, and wants a signed record that it was a gift and not a loan. It records the relationship, the amount, how and when the money was handed over, and the Donee's acceptance, in the Donor's lifetime.

A written record helps with a bank, a tax officer or a later family dispute: a bare bank entry does not say whether the money was a gift, a loan or a payment for something. Not for a gift of land, a house or a flat: use the Gift Deed / Transfer Deed between Blood Relations. Not for a gift to a minor: use the Gift Deed to a Minor. Not for a gift between husband and wife of property: use the Gift Deed Between Spouses. Not for a gift to a charitable trust: use the Gift Deed to a Charitable Trust. Not for a gift of jewellery, a vehicle or other things: use the Gift Deed of Jewellery, Vehicle or Movables. Not for a loan, which has to be repaid.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

Whether a deed that only records a gift of money needs stamp paper in Punjab or Chandigarh, and of what value, was not confirmed. Ask a licensed stamp vendor or the Sub-Registrar before you sign, and use stamp paper in the Donor's name if you are told to.

Registration

Whether a deed that gifts only money must be registered was not confirmed; ask the Sub-Registrar. A gift of movable property can be completed by delivery (s.123, Transfer of Property Act, 1882): here, handing over the cash or crediting the bank account, with the Donee accepting.

Notarisation

Not required by this form. Notarisation does not replace stamping or registration if either applies.

Witnesses

Two witnesses sign. Neither is the Donor or the Donee.
