When you need it

Use this Deed when one person gives jewellery, a vehicle or other movable things to a relative as a gift and wants a signed record of it. You choose in the questions what is being given, and the Deed then asks for the matching description (each piece of jewellery, the vehicle's registration and chassis details, or the other items), when the items are handed over, and the Donee's acceptance.

A gift of movable property is completed by handing the items over and the Donee accepting them. The signed Deed is the record that it was a gift and not a sale or a loan. Not for land, a house or a flat: use the Gift Deed / Transfer Deed between Blood Relations. Not for money: use the Gift Deed of Money. Not for a gift to a minor: use the Gift Deed to a Minor. For a vehicle, the library's Vehicle Gift Affidavit is the paper the RTO is likely to work from; this Deed is the family's own record. Not for a sale or a loan.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

Whether a deed gifting jewellery, a vehicle or other movables needs stamp paper in Punjab or Chandigarh, and of what value, was not confirmed. Ask a licensed stamp vendor or the Sub-Registrar before you sign, and use stamp paper in the Donor's name if you are told to.

Registration

A gift of movable property can be completed by delivery, with no registered instrument (s.123, Transfer of Property Act, 1882). Whether this Deed itself must be registered was not confirmed; ask the Sub-Registrar. For a vehicle, the change of ownership in the RTO's records is a separate step.

Notarisation

Not required by this form. Notarisation does not replace stamping or registration if either applies.

Witnesses

Two witnesses sign. Neither is the Donor or the Donee.
