When you need it

Use this Deed when one person (the Settlor) wants to set up a private trust for the family: the Settlor puts property in the hands of Trustees, who hold and manage it for the Beneficiaries named in the Deed. It records the Settlor, at least two Trustees, the Beneficiaries and how they share, the first property put in, the Trustees' powers, whether the Settlor can take the Trust back, and how and when the Trust ends.

A trust is more than a gift. The property is held by the Trustees for the Beneficiaries over time, under rules written down, which suits keeping property together for children, a family member who cannot manage it alone, or later generations. The Deed states no tax position and no stamp duty figure. If land or a building goes into the Trust, ask the Sub-Registrar before you sign whether it must be registered. Speak to a lawyer or chartered accountant before you choose whether the Trust is revocable. Not for a gift to a charity: use the Gift Deed to a Charitable Trust. Not for a trust created by a Will: use the Will Appointing an Executor. Not for a business trust, a public or religious trust, or a simple gift to one person: use the matching gift deed.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

The stamp duty on a trust deed in Punjab and Chandigarh was not confirmed; it may depend on what is put into the Trust. Ask a licensed stamp vendor or the Sub-Registrar before you sign, and use stamp paper in the Settlor's name if you are told to.

Registration

Whether this Deed must be registered was not confirmed. If land or a building goes into the Trust, ask the Sub-Registrar before you sign (clause 9.1 says the parties will do so). A Trust holding only money or movables is not stated to need registration.

Notarisation

Not required by this form. Notarisation does not replace stamping or registration if either applies.

Witnesses

Two witnesses sign, besides the Settlor and the Trustees. No witness is a party to the Deed.
