Why you need it

When you need it

A tenant has died, and one heir/occupant gives up whatever tenancy right they PERSONALLY have — often so the landlord can deal with possession or recognise another heir. Kept narrow: tenancy succession is statutory, not ordinary inheritance. Punjab: the Punjab Rent Act 1995 generally governs, but section 76(2) (section 75 in the Gazette text) saves the 1949 East Punjab Urban Rent Restriction Act for pre-commencement lettings. Chandigarh: the 1949 Act, extended to the UT. A signing heir can't extinguish another's independent statutory right. State the tenancy track, deceased tenant, heir status, possession and settlement — not a section 106 notice to quit, and doesn't replace a needed eviction order.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

Punjab: exact stamp article/duty was not confirmed — Article 55 may apply if treated as release of a vested right. Chandigarh: duty not confirmed either.

Registration

Registration consequence turns on the nature/duration of the tenancy right actually extinguished; no universal position was confirmed.

Notarisation

Notarisation does not replace a rent-control order or registration needed for a leasehold release.

Witnesses

The signing heir and optional landlord acknowledgment sign; independent witnesses are not required.

LEGAL BASIS

Punjab: Two rent statutes run side by side, split by the date of letting: premises let before 30 November 2013 stay under the East Punjab Urban Rent Restriction Act, 1949, and premises let on or after that date come under the Punjab Rent Act, 1995. The tenancy succession or continuation question is decided under the Act that governs this letting. This relinquishment binds only the signing heir own claim; it cannot extinguish another independent statutory right or replace the Rent Authority/Controller process. Exact stamp/registration treatment of the specific tenancy-right release was not confirmed.
