Why you need it

When you need it

For when a mortgaged property needs the first lender's written consent before a second charge — issued by the first lender, not a self-certification. States the existing loan, property, second lender, maximum amount, ranking, conditions and validity, preserving the first lender's priority and enforcement position. Not a release of the first mortgage — the mortgage instrument, stamping, registration and CERSAI filing are still separately needed. Pari passu ranking needs a fuller inter-creditor arrangement.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

No stamp duty — creates no right/title/interest, so not chargeable under Schedule I-A. The second mortgage is separately stamped.

Registration

Not registrable — creates no property right, outside s.17. The second mortgage follows its own s.59 rule.

Notarisation

Not required unless authenticated consent is wanted.

Witnesses

Not required for the NOC.
