You are supplying all the material yourself and engaging a thekedar (labour contractor) to supply mistris, mazdoors and their supervision for the construction or renovation — paid by square foot of work done, by the day per worker, or a lump sum for a described job. This records the rate, what the thekedar is and is not responsible for, and who answers for a labourer's safety and wages.

Not for a contractor who is also supplying material — use the House Construction Contract or the Interior Work Contract for that.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

Chargeable as an agreement, not a conveyance. PUNJAB: Article 5, Schedule I-A to the Indian Stamp Act, 1899 as applicable in Punjab, residuary rate under Article 5(c). Confirm the current figure with the Sub-Registrar or against revenue.punjab.gov.in before buying the stamp. CHANDIGARH: the equivalent agreement article under the Chandigarh Administration's table at revenue.chd.gov.in; confirm at the Sub-Registrar's office, 30 Bays Building. In practice, many labour-only arrangements below a modest value are not put on stamp paper at all; this note is for where the value is significant enough that the Parties want a stamped record.

Registration

Not compulsorily registrable under section 17 of the Registration Act, 1908 — no interest in immovable property is created.

Notarisation

Not legally required. Notarising only fixes the date of signing, which rarely matters for a labour-only job of short duration.

Witnesses

Not legally required. One witness per side is common where the job value is significant.

LABOUR-ONLY CONTRACT (THEKEDAR AGREEMENT)

This Agreement is made at Chandigarh on 2 April 2026

BETWEEN

Harpreet Kaur, resident of House No. 88, Sector 40-B, Chandigarh ("the Owner"),

AND

Gurdev Singh, resident of Village Kishangarh, Mohali ("the Thekedar").

1. THE WORK

1.1 The site of work is House No. 88, Sector 40-B, Chandigarh.

1.2 The Thekedar shall supply and supervise labour for: Masonry, plastering and flooring labour for a first-floor addition of approximately 900 square feet, material to be supplied by the Owner

1.3 The Owner is supplying: All cement, sand, bricks, steel, tiles, fittings and tools other than the Thekedar’s own hand tools. The Thekedar supplies only labour, supervision and its own hand tools, and is not responsible for any shortage or defect in material supplied by the Owner.

1.4 The Thekedar shall deploy 6 to 8 workers depending on the stage of work.

2. RATE AND PAYMENT

2.1 The labour is paid on a rate per square foot of work completed, at ₹45 (Rupees Forty Five only).

2.2 Payment schedule: Weekly payment every Saturday against measured work, final 10% on completion and clearing of debris

2.3 The Owner has paid the Thekedar an advance of ₹10,000 (Rupees Ten Thousand only) on signing, adjustable against future payments.

3. TIME

3.1 Work shall start on 1 April 2026 and is expected to finish on or about 2 April 2026, subject to material being available from the Owner as and when needed and to ordinary weather delay.

4. LABOUR, WAGES AND SAFETY

4.1 The Thekedar is solely responsible for the wages, conduct, discipline and day-to-day safety of every worker it deploys, and for compliance with applicable labour law in respect of their wages and welfare, and shall keep the Owner indemnified against any claim by a worker arising from the Thekedar's failure to do so.

4.2 The Owner shall provide safe access to the site and shall not be treated as the employer of any worker deployed by the Thekedar.

4.3 Either the Owner or the Thekedar may end this arrangement on seven days' notice, or immediately for a serious breach, without prejudice to payment already earned for work completed.

5. GENERAL

5.1 This Agreement is the entire understanding between the Parties on the labour work described above.

IN WITNESS WHEREOF the Parties have signed this Agreement at Chandigarh on 2 April 2026.
