MODEL BYE-LAWS OF A RESIDENTS' WELFARE ASSOCIATION
Green Park Residents Welfare Association
Adopted by the general body of members on 1 April 2026.
- 1. NAME, OFFICE AND AREA
The name of the Association is Green Park Residents Welfare Association (the "Association"). Its office is at Sector 21, Panchkula. It works for the residents of Green Park Colony, Sector 21, Panchkula, consisting of 240 houses and common areas (the "Area").
- 2. NATURE OF THE ASSOCIATION
The Association is registered as a society under the Societies Registration Act, 1860, as it applies in the State or Union Territory. It is not run for profit, and no part of its income or property is paid or handed to any member.
- 3. OBJECTS
The objects of the Association are: (a) to look after the common areas, services and security of the Area; (b) to collect and spend maintenance charges for them; (c) to promote harmony and welfare among the residents; (d) to represent the residents before the authorities, the builder and others; and (e) to do whatever else helps these objects.
- 4. MEMBERSHIP
Every owner or allottee of a residential unit in the Area is a member, with one membership for each unit. A person applies in writing to the Secretary and the managing committee admits the person after checking the title papers. The entrance fee and subscription, if any, are those the general body fixes. Joint owners have one vote between them.
- 5. END OF MEMBERSHIP
Membership ends when a member ceases to own the unit, resigns in writing or dies. The person who succeeds to the unit may apply for membership. The general body may remove a member for a serious and continuing breach of these bye-laws, but only after giving the member a chance to be heard and only as the law allows.
- 6. GENERAL BODY
The general body of all members is the highest authority of the Association. It meets at least once a year, within 6 months of the end of the financial year, to receive the report and accounts, appoint the auditor, approve the budget and elect the managing committee when due. Each member gets at least 14 clear days' written notice of a meeting, with the agenda.
- 7. SPECIAL MEETINGS, QUORUM AND VOTING
A special general meeting may be called by the managing committee, or by the Secretary on a written requisition of one-fifth of the members. The quorum for any general meeting is one-fifth of the members. If a quorum is not present half an hour after the appointed time, the meeting is adjourned to a date and time the Chair fixes, and the members present at the adjourned meeting form the quorum. Each unit has one vote. A member votes in person only. Questions are decided by a majority of the votes cast, except where these bye-laws or the law require more.
- 8. MANAGING COMMITTEE
The Association is managed by a committee of 9 members: the President, the Vice-President, the Secretary, the Treasurer and the other members. They are elected by the general body by secret ballot from among the members whose dues are paid, for two years. A vacancy is filled by the committee until the next general body meeting. The general body may remove an office-bearer by a resolution passed by the majority these bye-laws require for an amendment, after giving the office-bearer a chance to be heard.
