- Builder-to-Society Handover Letter and ChecklistWhen a promoter hands over a finished project to the residents' body — documents, common areas, utilities, warranties/AMCs, corpus, accounts — via the promoter's letter plus the committee's ticked-schedule acknowledgement of what was actually delivered. Use after the OC and society/association registration. RERA-registered projects only — an unregistered one follows the agreements for sale and state ownership-flats law instead, with a shorter defect-liability period (Maharashtra: 3 years, s.7 MOFA 1963, vs RERA's 5-year s.14(3)). Primarily Maharashtra co-operative societies (MCS Act 1960); AOA/RWA options for Karnataka, Delhi, Gujarat, Tamil Nadu, West Bengal only. Not a conveyance/deed of apartment; not for a no-OC project or direct promoter-to-buyer handover.₹99खोलें
- Application for Membership and Transfer of SharesThe buyer's own application to the committee: admit me, transfer the outgoing member's shares to my name. Buying the flat alone doesn't make you a member — the agreement gives title, only the committee's resolution gives membership. For a Maharashtra society (MCS Act 1960, Model Bye-laws 2014); covers purchase, gift, or transmission to a nominee/heirs. Not for an AOA; not other states without resetting citations; not a company/firm/trust/HUF purchaser.₹99खोलें
- Nomination Form for Society MembershipA member files this to name who receives shares/interest on death. S.30, Maharashtra Co-operative Societies Act 1960 with Rule 25, MCS Rules 1961 obliges transfer to the nominee once death is proved; with none recorded, the family faces the slower heirship-certificate/indemnity route. Revokes every earlier nomination; works only once the society enters it while you're alive (Rule 25(4)) — deliver to the secretary, get the acknowledgement. Not a will — a nominee takes as trustee for the heirs. Not for an AOA (e.g. Maharashtra Apartment Ownership Act 1970) — no shares, no s.30 nomination. Always names a nominee — to revoke without one, write separately.₹99खोलें
- Share Certificate (Co-operative Housing Society)What a society issues to evidence a member's shares (usually 5-10 shares of Rs 50 each) and, with the Register of Members, the right to occupy a flat — needed for a bank loan or a buyer's due diligence. Issued on admission (Maharashtra: within 6 months — Rule 21, MCS Rules 1961, Bye-law 9); endorsed on transfer; reissued as a duplicate after loss. For Maharashtra, Karnataka, Delhi, Gujarat, Tamil Nadu, West Bengal. Not for an AOA/RWA (no share capital); not to transfer the flat — needs a registered deed.₹99खोलें
- Duplicate Share Certificate ApplicationFor a lost, destroyed, damaged, illegible or never-received share certificate. The society checks the register and bye-law safeguards before issuing a duplicate — fee, publication period and indemnity format aren't fixed by statute; follow the bye-laws. State the certificate/share numbers, the loss, and any report/publication/indemnity given; a duplicate restates the record, not ownership. Punjab: Punjab Co-operative Societies Act, 1961, Rules; Chandigarh: same Act, 1963 Rules. Disputes: Registrar, s.55.₹99खोलें
- Application to Add a Joint MemberTo record another person as a joint member matching an approved joint ownership, family or co-purchaser interest — not an associate member or nominee; status follows the Act, Rules and bye-laws. S.15 (who may be a member) and s.17 (rights after payment), Punjab Co-operative Societies Act, 1961; Chandigarh: same Act, 1963 Rules. Both the primary and joint member sign. A refusal is appealable under s.68(c) within 60 days, subject to condonation.₹99खोलें
- Objection to the Admission of a MemberTo dispute another person's proposed admission — eligibility, transfer basis, succession claim, or documents — on statutory/bye-law grounds, not personal opposition. S.15, Punjab Co-operative Societies Act, 1961 names who may be a member; bye-laws add conditions; Chandigarh: same Act, 1963 Rules. A membership entry can't decide an unresolved title/succession dispute. Management disputes: Registrar, s.55; a wrongly refused applicant may still appeal under s.68(c).₹99खोलें
- Resignation of MembershipTo resign society membership, tied to the share register, property position and dues — don't resign while still owning the linked dwelling or before shares/property transfer completes. Governed by the Punjab Co-operative Societies Act, 1961 and bye-laws (Chandigarh: same Act, 1963 Rules); notice period and refund timetable aren't fixed by statute. State the certificate and property position; ask for final dues/share treatment, don't assume automatic repayment. Disputes: Registrar, s.55.₹99खोलें
- Share Certificate Transfer EndorsementOnce the society approves a share/interest transfer and the certificate needs an endorsement matching the member/share register. S.20, Punjab Co-operative Societies Act, 1961 restricts transfer to the Act/Rules/bye-law conditions (Chandigarh: same Act, 1963 Rules). State transferor, transferee, certificate, share numbers, approval, effective date. Doesn't convey the flat/plot/leasehold title itself — needs separate conveyance/registration/Estate Office action. Disputes: Registrar, s.55.₹99खोलें
- Society Admission Fee ReceiptTo issue a clean admission-fee receipt that doesn't imply payment alone confers membership. State the applicant/member number, amount, mode and application status. S.15, Punjab Co-operative Societies Act, 1961 governs eligibility; bye-laws fix the fee; s.17 governs rights after payment, but a committee decision is still needed. Chandigarh: same Act, 1963 Rules. Needs a Re 1 stamp above Rs 5,000 (Art.53, Sch.I) in both.₹99खोलें
- Associate Membership ApplicationTo be recorded as an associate member connected to an existing member — status doesn't automatically carry full voting, ownership or transfer rights; it follows the Act, Rules and the society's own bye-laws, since no single provision for this category was confirmed across every Punjab/Chandigarh society. Punjab: Punjab Co-operative Societies Act, 1961; Chandigarh: same Act, 1963 Rules. State the primary member, property/share link, relationship and rights sought. Disputes: Registrar, s.55.₹99खोलें
- Member Register Extract RequestFor an authenticated register extract (membership status, admission date, shares, nomination, transfer or cessation) instead of an email or bill. A statutory record under the Punjab Co-operative Societies Act, 1961, Rules and bye-laws (Chandigarh: same Act, 1963 Rules); no section fixing the copy fee/delivery period was confirmed. State the member number, exact scope and purpose — don't sweep in unrelated members' data. A refusal touching society business: Registrar, s.55.₹99खोलें
- Society Membership ApplicationTo seek admission to a society's membership and share records after acquiring or being allotted a dwelling, plot or interest — possession or paying maintenance alone doesn't make you a member. S.15, Punjab Co-operative Societies Act, 1961 states who may be a member; s.17 governs rights after payment (Chandigarh: same Act, 1963 Rules). Tender the share capital/admission fee; state the property basis, eligibility, documents. A wrongful refusal is appealable under s.68(c) within 60 days.₹99खोलें
- Appeal Against Rejection of MembershipTo appeal a society's refusal to admit you, under s.68(c), Punjab Co-operative Societies Act, 1961. Appeal period: 60 days under s.68, delayed admission on sufficient cause. State the rejection date/resolution, original application, the precise eligibility error, and overlooked documents. The correct appellate authority (s.68(2)) depends on who decided and their delegated powers — check the rejection order. Chandigarh: same Act, 1963 Rules, local Registrar.₹999खोलें
- Change of Nomination FormTo change who is nominated to receive a member's share/interest on death. S.21, Punjab Co-operative Societies Act, 1961 lets the society transfer to the nominee, or absent one, to the heir/legal representative — a transmission mechanism, not a will deciding property rights. Punjab: Act, Rules, bye-laws; Chandigarh: same Act, 1963 Rules. State the membership, certificate, existing nominee if any, new nominee and replacement scope. Disputes: Registrar, s.55.₹99खोलें
- Transmission of Shares on DeathFor transmitting a deceased member's share/membership record through the society's statutory process. S.21, Punjab Co-operative Societies Act, 1961 lets the society transfer to the nominee or, absent one, the heir/legal representative. State the deceased member, death certificate, certificate and succession basis — nomination alone doesn't decide title where a separate will, probate or registration process is needed. Punjab: Act, Rules; Chandigarh: same Act, 1963 Rules. Rival claims: Registrar, s.55.₹99खोलें

- Statement of Unpaid Common Expenses (Association No-Dues Certificate)Before money changes hands on a Mohali, Zirakpur, Dera Bassi, New Chandigarh, Kharar, Ludhiana or Chandigarh-sector flat, get the association's statement of what's owed and its clear-up-to date. Punjab apartments: unpaid common expenses charge the flat (s.26, Punjab Apartment Ownership Act, 1995); a purchaser is jointly/severally liable for all arrears up to transfer (s.27(1)) — inherited with the flat. S.27(2) is the escape: any purchaser may demand this statement from the Board of Management and is then liable only to the stated amount. Two consequences shape this template: the right belongs to the PURCHASER (form records who's asking; a purchaser's demand letter is an alternate cover page), and the ceiling applies only where the Act is notified — NOT in Chandigarh (no apartment-ownership statute; Chandigarh Apartment Rules, 2001 repealed from 1 October 2007). The form records body type and location so a Chandigarh flat can't claim the Punjab ceiling; the statutory-charge paragraph prints only if the association confirms both — otherwise it defaults to: no ceiling, hold a retention. Needed at: resale (before completion); loan sanction/mortgage release; transfer to nominee/heirs on death or gift; a Chandigarh co-op society's membership substitution (Registrar clearance); or account closure. NOT an NOC (NOC = no objection to transfer; this = money is clear) — most transfers need both, same day; match names/flat number on each. NOT the Estate Office No Dues Certificate (Estate Office, Town Hall Building, Sector 17-C, Chandigarh — ground rent/lease money/extension fee/penalties on the SITE, a government document) — a Chandigarh leasehold sale needs both. Value sits in one date: 'dues paid till date' is worthless (quarterly-advance billing from 1 April already collected to 30 June; arrears billing, only to 31 March). This template states three dates separately — bills raised to, payment credited to, and the Clear-Up-To Date — with a self-check, and fixes what happens to a later-found earlier-period charge. NOT for: (1) no registered body, promoter/agency still running accounts (common in Zirakpur, Dera Bassi, peri-urban Mohali, promoter never applied under s.17) — use the agency's own clearance letter instead (contractual, not a charge on the flat); the promoter's non-registration is itself a default under s.17 (apply within 3 months of the allotment/sale threshold after the OC, else the allottee may; threshold was one-third, s.17 substituted by Punjab Act 17 of 2021, reportedly moved). (2) Estate Officer leasehold clearance or Chandigarh Housing Board clearance — go there instead. (3) A Phase-I Chandigarh unit's floor-wise co-owner division — barred: Supreme Court, 10 Jan 2023 (Residents Welfare Association v. UT Chandigarh) bars such fragmentation and any co-owner MOU for it; the Estate Officer's notice effective 10 Feb 2023 also stopped transfers/mutations outside four permitted categories pending the Heritage Conservation Committee — status unconfirmed when drafted; clause 20 states this. Get: one signed original on letterhead (outward-register reference, seal, Hon. Secretary plus normally President/Chairperson) — ask for two, plus a 2-3 year ledger extract and the last three receipts. The certificate is only as good as the books behind it.₹99खोलें
- Society Parking Allotment LetterFor a committee allotting parking — first allotment, renewal, vehicle change, or a fresh draw — establishing that the society allots USE, not a sale. Open/stilt parking is common property (Nahalchand Laloochand v. Panchali Co-op HS, (2010) 9 SCC 536) — unsellable by promoter or member. For Maharashtra, Karnataka, Delhi, Gujarat, Tamil Nadu, West Bengal. Not for an AOA/RWA (Deed of Declaration governs); not a saleable owned garage or a builder-controlled society.₹99खोलें
- NOC for Interior Renovation Work (Society to Member)The committee's written permission for interior work — flooring, ceiling, kitchen, wardrobes, painting, in-flat rewiring, bathroom fittings — with allowed scope, hours, debris removal, deposit and damage indemnity. For ordinary interior work; refuse anything touching a structural member, elevation, common areas, or a toilet/duct's position without a structural engineer's certificate and municipal permission (optional clause covers that). Not for a merger, balcony enclosure, loft or built-form change; not redevelopment, pre-possession fit-out, or a tenant applicant.₹99खोलें
बैठकें, प्रस्ताव और कामकाज
- Minutes of the Annual General Meeting (Co-operative Housing Society)The Society's only proof of what its general body decided; an unminuted decision is hard to prove to the Registrar, a bank or an auditor. For a Punjab/Chandigarh AGM under the Punjab Co-operative Societies Act, 1961, 1963 Rules and bye-laws — covering minutes confirmation, annual report, accounts, profit, auditor, budget, admissions, bye-law amendments, property, committee election, special business, plus presiding officer, notice, defaulters, quorum, voting. Not for a special/committee meeting, an AOA or an RWA.₹99खोलें
- Notice of Annual General Meeting (Co-operative Housing Society)The AGM is the meeting a society can't skip — the general body gets the annual report, accounts, profit disposal, auditor and next year's programme, and elects the committee when due. Punjab: within 6 months of year-end (31 March year-end means by 30 September); Chandigarh: same Act, 1963 Rules. States the business, notice period, quorum, quorum-failure and voting. Not an AOA, an RWA, or a special general meeting.₹99खोलें
- Resolution of the Managing CommitteeA committee's decisions bind the society only if properly convened and empowered — recording meeting particulars, notice, quorum, the empowering provision, the resolution, and a certified extract for a bank/contractor/Registrar. For what the committee itself may decide (contractor appointment within limit, bank operation, authorising a signatory, routine repairs) — not bye-law amendments, spending/borrowing beyond limit, disposing of property, or the sinking fund (general body only), nor a general-body resolution. Against the Maharashtra Co-operative Societies Act 1960, Rules 1961, Model Bye-laws 2014; usable elsewhere by naming your own statute.₹99खोलें
- Complaint to the Registrar of Co-operative SocietiesWhen a committee won't transfer a flat, show records, hold the AGM, or spend within authority, complain in writing to the Registrar of Co-operative Societies for the ward/taluka: correct addressee, your capacity, dated facts, the provision breached, relief sought. Forum matters — the Registrar is supervisory; a constitution/management/business dispute goes to the state's designated forum instead (Co-operative Court in Maharashtra, Registrar/nominee in Karnataka/Delhi, Board of Nominees in Gujarat, designated authority in Tamil Nadu/West Bengal); wrong forum costs months and limitation. Six states supported — supply the breached section yourself (Maharashtra: MCS Act 1960, Rules 1961, model bye-laws). Not for an AOA/RWA.₹99खोलें
रखरखाव, बकायेदार और वसूली
- Notice of Default and Demand for Arrears (Co-operative Housing Society)The formal demand before recovery: period, principal, interest, rate, the bye-law it rests on, a pay-by date — sent once reminders fail; in Maharashtra, what the Registrar/Co-op Court looks for first. For a Maharashtra society (MCS Act 1960, Rules 1961, Model Bye-laws 2014), alt. clause for other states. Not for an AOA/RWA (no s.91/s.101 route, civil suit instead); not pre-registration or against a tenant.₹99खोलें
- Society Maintenance BillThe periodic bill for society charges — tax, water, electricity, repairs/sinking fund, lift, parking, non-occupancy charges, insurance, arrears interest — itemised the same way every cycle (itemisation is what a s.101 MCS Act recovery officer checks). For Maharashtra (MCS Act 1960, Rules 1961, Model Bye-laws 2014). Not for an AOA, other states' societies, an unregistered RWA/pre-conveyance complex, or a one-off premium/levy/arrears notice.₹99खोलें
- Notice Restricting Amenities for DefaultTo restrict a non-essential amenity (club, booking, optional facility) for a defaulting member, without touching essential services. Authority must come from the bye-laws — no universal power to disconnect essential services for arrears was confirmed. State the arrears, prior demand, the amenity restricted, start date, and a contest route; water, sanitation, access, lifts and fire-safety stay protected. Punjab: s.55, Punjab Co-operative Societies Act, 1961; Chandigarh: same Act, 1963 Rules.₹99खोलें
- Defaulter Reminder NoticeFor a first formal reminder of an unpaid balance, stated clearly, not as an adjudicated debt. Separate principal, interest and late charges; show the ledger period and a route to flag a wrong charge — no default rate is assumed, it must come from the bye-laws, a resolution or an award. Punjab: s.55, Punjab Co-operative Societies Act, 1961; Chandigarh: same Act, 1963 Rules. Not a recovery certificate.₹99खोलें
- Reference of a Dispute to the RegistrarOnce a dispute on the society's constitution, management or business must go to the Registrar, not a civil suit. S.55, Punjab Co-operative Societies Act, 1961 requires it; s.82 bars civil/revenue-court jurisdiction. State the parties, dispute type, facts, prior decision, documents and relief — keep a title controversy separate. Chandigarh: same Act, 1963 Rules. Filing fee/limitation for a s.55 reference weren't confirmed.₹99खोलें
- Final Notice Before Recovery ProceedingsAs the final notice before moving to statutory dispute or recovery. State the earlier demand, ledger, principal, interest, final payment date, and what follows if unresolved — don't threaten a recovery certificate unless the debt qualifies. S.55, Punjab Co-operative Societies Act, 1961 is the Registrar route; Rule 79-A/Appendix H under s.67-A (1963 Rules) is separate recovery machinery. Chandigarh: same Act, Rules.₹99खोलें
- Interest on Arrears StatementFor a standalone interest calculation, checkable independently of the demand notice: opening principal, period, rate, credits and method, not a lump sum. No default rate is assumed — it comes from the bye-laws, a resolution, a loan arrangement or an award. Punjab: s.55, Punjab Co-operative Societies Act, 1961; Chandigarh: same Act, 1963 Rules. This is evidence/calculation, not a new charge.₹99खोलें
- Maintenance Charge Revision NoticeTo tell members a maintenance-contribution change: old/new charge, approved basis, cost breakup, billing cycle, first due date, and a route to challenge a ledger error. The power to fix maintenance sits in the bye-laws and the resolution/budget adopted under them — no universal formula is assumed. Punjab: s.55, Punjab Co-operative Societies Act, 1961; Chandigarh: same Act, 1963 Rules.₹99खोलें
- Recovery Certificate ApplicationWhen a debt qualifies for a statutory recovery certificate through the Registrar — not every invoice qualifies. Rule 79-A/Appendix H, Punjab Co-operative Societies Rules, 1963 prescribes the form under s.67-A; s.55 separately covers business disputes. Chandigarh: same Act, 1963 Rules. Record the source debt, due date, rate, calculations, service and hearing status; if liability is contested and s.67-A doesn't fit, use the dispute route first.₹99खोलें
- Settlement of Arrears AgreementFor a negotiated payment schedule, waiver or interest arrangement settling arrears instead of statutory recovery — must be precise, since a vague instalment promise creates a second dispute. State the admitted principal, interest, settlement amount, payment dates, cure period, and the release on full performance. S.55, Punjab Co-operative Societies Act, 1961 stays relevant if a dispute is before the Registrar (Chandigarh: same Act, 1963 Rules). No essential-service disconnection; Registrar-filed consent terms must match the settlement.₹399खोलें
- Sinking Fund Demand NoticeFor a sinking-fund/reserve demand for future major repair, kept separate from ordinary maintenance. State the approved purpose, per-unit calculation, resolution, due date and accounting treatment — no universal percentage is assumed. Punjab: s.55, Punjab Co-operative Societies Act, 1961; Chandigarh: same Act, 1963 Rules. Keep the demand traceable to the resolution and ledger.₹99खोलें
- Special Levy Resolution and DemandFor a one-time levy for a defined extraordinary expense, not a permanent rise. Records the approving resolution and the demand: purpose, total amount, allocation formula, member share and schedule. Authority/voting threshold come from the bye-laws — no universal percentage is assumed. Punjab: s.55, Punjab Co-operative Societies Act, 1961; Chandigarh: same Act, 1963 Rules.₹99खोलें
