When you need it

A declaration to your insurer changing, or naming for the first time, the nominee who is to receive the money payable under your insurance policy on your death — the person the insurer pays first, quickly, without waiting to work out who your legal heirs are. Use it whenever your earlier nominee has died, whenever your family circumstances have changed since you last named one, or simply because you have changed your mind; section 39 of the Insurance Act, 1938 lets you change a nomination as often as you like, for no reason you have to justify to the insurer.

Nomination law is central and the same everywhere in India. Section 39 of the Insurance Act, 1938 — as substituted by the Insurance Laws (Amendment) Act, 2015 — and the IRDAI Master Circular on Protection of Policyholders' Interests, 2024, which requires every insurer to run a simple, seamless procedure for registering a change of nomination, apply in the same words whether your policy was bought in Zirakpur or anywhere else. This declaration does not pretend Punjab or Chandigarh decides that. What Punjab and Chandigarh do decide is where you sign this declaration, and, if you or your insurer choose to have it sworn, which notary's or oath commissioner's practice governs — covered in the formality notes below. Read this before assuming it applies to every kind of policy. Section 39, in its own words, is about a policy of life insurance on the policyholder's own life; this platform extends the same declaration, on the same principles, to a personal accident or health policy that names a nominee under its own terms — but the statutory footing for those two is the policy's own nomination condition and IRDAI's general regulations, not section 39 itself. A change of nomination is registered by the insurer, not created by this declaration alone: it takes effect from the date the insurer records it in its own books, not from the date you sign it — send this declaration to the insurer promptly, and keep its written acknowledgment. Stamp duty

Where this declaration is sworn as an affidavit, it is stamped, in both Punjab and Chandigarh, under Article 4 of Schedule I-A to the Indian Stamp Act, 1899 as applicable to Punjab, and under the equivalent entry in the Chandigarh Administration's own stamp schedule — the same small fixed duty this platform's other sworn declarations state, commonly printed as Rs 25 on claim forms and notarial counters, though neither Punjab's nor Chandigarh's own published stamp schedule lists a rate against "affidavit" by name, so confirm the current denomination with the stamp vendor before it is bought. But swearing this declaration is not something section 39 of the Insurance Act, 1938 itself requires. The section asks only for an endorsement on the Policy and written notice to {{insurer_name}}, and says nothing about a stamp. Where {{insurer_name}}'s own nomination form is content with a plain signed declaration, no stamp is payable on it at all, in either Punjab or Chandigarh — use this declaration in its sworn, stamped form only where {{insurer_name}} specifically asks for a notarised one, or where the circumstances (a change made by a power of attorney holder, or one recorded a long time after the event that prompted it) make a sworn form worth having.

Registration

Not registrable in either Punjab or Chandigarh. Section 17 of the Registration Act, 1908 reaches instruments that create, declare, assign, limit or extinguish a right in immovable property, or certain other listed transactions; a nomination does none of those things even in the ordinary case, and the 2015 amendment to section 39 of the Insurance Act, 1938 (paragraph 4.2 of this declaration) leaves most nominees holding the money only as a trustee for the Policyholder's heirs rather than as a beneficial owner — so there is no property interest here for the Registration Act, 1908 to reach in the first place. Send the original to {{insurer_name}} and keep a copy for your own record.

Notarisation

Not a precondition of a valid change of nomination in either Punjab or Chandigarh — section 39 of the Insurance Act, 1938 is satisfied by an endorsement on the Policy and written notice to {{insurer_name}}, neither of which the section asks to be sworn. Swear or affirm this declaration before a Notary Public, an Oath Commissioner, or an Executive Magistrate empowered to administer oaths, under section 3 of the Oaths Act, 1969, only where {{insurer_name}}'s own form asks for a sworn declaration rather than a plain signed one. Where it is sworn, sign it in the officer's presence, not before; in Chandigarh a notarised declaration is accepted wherever an authority would otherwise insist on attestation by an Executive Magistrate, and in Punjab, District Courts have Oath Commissioners and most tehsil headquarters have a Notary.

Witnesses

No attesting witness is required by law in either Punjab or Chandigarh — where this declaration is sworn, the jurat, not a witness, authenticates it. {{insurer_name}}'s own form occasionally asks for an independent witness, which is why this declaration provides for up to two; leave both blank if none is asked for.

I, Simran Kaur Bajwa, daughter of Sardar Baldev Singh Bajwa, aged about 39 years, Service by occupation, resident of House No. 3162, Sector 47-D, Chandigarh 160047, PAN AFZPB6543M, being the holder of the Policy described below, held jointly with X, do solemnly declare and affirm as follows.

  1. 1. THE POLICY

1.1 I hold Policy No. LIFE/2019/0038812 ("the Policy"), being a policy of life insurance, issued by Sarvodaya Life Insurance Company Limited, commencing on 1 April 2026.

4.2 The person or persons named in paragraph 4.1 are a parent, spouse or child of mine, or some combination of them, and the money secured by the Policy will accordingly be payable to them in their own right and for their own benefit, as section 39 of the Insurance Act, 1938 provides for such a nominee.

4.3 The following nominee or nominees named in paragraph 4.1 are minors: Arjun Singh Bajwa, aged 14 years; Naina Kaur Bajwa, aged 11 years. I appoint Harpreet Singh Bajwa, brother of the Policyholder to receive the money secured by the Policy on my death, for so long as that nominee remains a minor, under section 39(2) of the Insurance Act, 1938.

  1. 5. ASSIGNMENT OF THE POLICY

5.1 This Policy is not currently assigned to any person. I am aware that, where the Policy is currently assigned to any person other than Sarvodaya Life Insurance Company Limited itself by way of security for a loan, this change of nomination does not affect the rights of that assignee for as long as the assignment subsists.

  1. 6. WHEN THIS CHANGE TAKES EFFECT

6.1 This declaration cancels every nomination I have previously made on the Policy. The nomination in paragraph 4 takes effect from the date Sarvodaya Life Insurance Company Limited records it in its own register relating to the Policy, and not from the date of this declaration.
