LEGAL BASIS

A registered mortgage appears in the Sub-Registrar's registers and in a Punjab Non-Encumbrance Certificate, but the certificate cannot report an equitable mortgage created by deposit of title deeds. The lender's own written confirmation of the charge and of the documents it holds, and a search of the Central Registry of Securitisation Asset Reconstruction and Security Interest of India, are how such a charge is found. On repayment, ask for the lender's no-dues letter, the release of the original documents and written confirmation that the charge has been satisfied in the Central Registry records.
