Part A is the application to the Accounts Officer for a No Dues Certificate. Part B is the joint application by the Allottee and the Purchaser to the Secretary for a No Objection Certificate for transfer of lease rights, made under section 2.1 of the Board's Citizens' Charter dated 27 September 2022 read with Regulation 16 of the Chandigarh Housing Board (Allotment, Management and Sale of Tenements) Regulations, 1979. Annexures A to D are the two affidavits and the two indemnity bonds the Board's checklist requires. Annexure E is filed only where an attorney is acting. This pack is drafted throughout for a residential dwelling unit; a convenient shop, small booth, bay shop or shop-cum-flat is not covered by it.

SUBJECT: Application for issuance of a No Dues Certificate in respect of Dwelling Unit No. 3142-B, Sector 45-C, Chandigarh.

1. The Applicant. Harbans Singh Gill, son of Late Sh. Gurdial Singh Gill, and Rajwant Kaur Gill, son of Harbans Singh Gill (the Allottee), being the allottee or allottees of record of the Dwelling Unit described below.

5. The Dwelling Unit. Dwelling Unit No. 3142-B, Sector 45-C, Chandigarh, of the EWS category, standing on the ground floor, having a covered area of about 1,050 square feet, allotted under the Self Financing Housing Scheme, 1996 (the Dwelling Unit).
6. Registration number. CHB/45C/3142/1998.
7. Allotment and possession. The Dwelling Unit was allotted vide Allotment Letter No. CHB/AL/45C/3142/1998 dated 1 April 2026, and physical possession of it was delivered to the Allottee on 4 April 2026.
8. Details of payments made. Earnest money Rs 50,000 paid 12 March 1998 (Receipt No. 4471); balance premium Rs 6,80,000 paid in 60 monthly instalments from May 1998 to April 2003; final instalment Receipt No. 22118 dated 7 April 2003; ground rent paid to 31 March 2026 vide online challan CHB/2026/00981 dated 4 April 2026.
9. Purpose of this application. The No Dues Certificate is required so that a self-attested copy of it may be enclosed with the joint application at Part B below for the grant of a No Objection Certificate for transfer of the lease rights in the Dwelling Unit. An attorney is acting in this matter: Jasbir Singh Gill, son of Late Sh. Gurdial Singh Gill, resident of House No. 3021, Sector 47-D, Chandigarh 160047, attorney of the Allottee under a General Power of Attorney dated 8 January 2024, registered as Document No. 1123 in Book No. 4, Volume 88, at pages 71 to 76, in the office of the Sub-Registrar, U.T. Chandigarh. Where the party so represented is the Applicant, this application is signed by the attorney in that capacity and the Applicant does not sign again; the attorney's affidavit at Annexure E is filed with the pack.
10. Undertaking. The Applicant undertakes to pay forthwith any amount found outstanding on scrutiny of the Board's account for the Dwelling Unit, whether on account of premium, instalments, interest, ground rent, penalty, service charges or goods and services tax, and accepts that the certificate applied for speaks only as at its own date.

Sir / Madam,
The Allottee and the Purchaser apply jointly, as section 2.1 of the Board's Citizens' Charter requires, and respectfully state as follows.
1. The Dwelling Unit. Dwelling Unit No. 3142-B, Sector 45-C, Chandigarh, of the EWS category, standing on the ground floor, having a covered area of about 1,050 square feet, allotted under the Self Financing Housing Scheme, 1996, carried on the Board's record under Registration No. CHB/45C/3142/1998 (the Dwelling Unit), described more fully in the Schedule at the end of this application.
2. Allotment and possession. The Dwelling Unit was allotted vide Allotment Letter No. CHB/AL/45C/3142/1998 dated 1 April 2026, and physical possession of it was delivered to the Allottee on 4 April 2026.
3. Tenure. The Applicants state that no Deed of Conveyance has been executed in respect of the Dwelling Unit, which continues to be held on leasehold basis from the Board, and that a registered Sub-Lease Deed has already been executed between the Board and the Allottee in respect of the Dwelling Unit.
4. Present use. The Dwelling Unit is at present being used for residential use by the Allottee and the members of the Allottee's family, and for no other purpose.
5. Particulars of the Allottee. Harbans Singh Gill, son of Late Sh. Every person standing on the Board's record as allottee or transferee of the Dwelling Unit has signed this application, has sworn a separate affidavit in the terms of Annexure A and has executed a separate indemnity bond in the terms of Annexure B.
6. Particulars of the Purchaser. Ankit Mehra, son of Sh. Vinod Mehra, resident of Flat No. 802, Tower 4, Sector 20, Chandigarh 160020, mobile +91 XXXXX XXXXX, e-mail ankit.mehra@example.com, Aadhaar No. 0000 0000 0000, PAN BBBPB0000B, and Sneha Mehra, son of Sh. Ramesh Chandra, resident of Flat No. 802, Tower 4, Sector 20, Chandigarh 160020 (together the Purchaser). The Purchaser has signed this application, has sworn the affidavit at Annexure C and has executed the indemnity bond at Annexure D, and self-attested copies of the Purchaser's photo identity proof, Aadhaar card and PAN card, together with three self-attested photographs and specimen signatures, are enclosed.
7. Nature of the proposed transaction. The Allottee proposes, subject to the permission now sought, that the lease rights in the Dwelling Unit be transferred in favour of the Purchaser by way of sale for monetary consideration, for a consideration of ₹85,00,000 (Rupees Eighty Five Lakh only). The whole of the Allottee's interest in the Dwelling Unit is to move; no share, portion or floor of it is being carved out, and no fragmentation of the site is intended or will be sought.
8. The instrument proposed. On the grant of the No Objection Certificate the Applicants will execute a deed of transfer of the lease rights in the Dwelling Unit by way of sale for monetary consideration, and will present it for registration before the Sub-Registrar, U.T. Chandigarh, 30 Bays Building, Sector 17, within the time allowed by section 23 of the Registration Act, 1908.
9. No transfer before permission. The Applicants are aware, and state, that the lease rights in the Dwelling Unit cannot be transferred and no such deed can be executed or presented for registration until the No Objection Certificate applied for is granted in writing, and that any deed executed before then is liable to be treated by the Board as a breach of the conditions of allotment.
10. The lock-in period. The Applicants state that the lock-in period of five years from the date of physical possession expired before the date of this application. The grounds on which relaxation is sought are these: The Allottee has been transferred out of Chandigarh on permanent posting with effect from 1 March 2026 and is undergoing treatment for a chronic condition; the entire price of the Dwelling Unit has been paid to the Board.
11. Dues. The Applicants state that all outstanding dues in respect of the Dwelling Unit, including premium, instalments, interest, ground rent, penalty, service charges and goods and services tax, stand paid in full as at the date of this application. A No Dues Certificate bearing No. CHB/AO/NDC/2026/1187 dated 2 April 2026 has been issued by the Accounts Officer and a self-attested copy of it is enclosed. The Applicants accept that any amount found due on scrutiny, whether on account of premium, instalments, interest, ground rent, penalty, service charges or goods and services tax, must be paid before the No Objection Certificate is acted upon.
12. Competence to contract. Each of the Applicants is of sound mind, is eighteen years of age or above, and is not disqualified from contracting by any law to which that Applicant is subject.
13. Litigation and title. The Applicants state that the Dwelling Unit is free from any dispute or litigation touching its title or ownership, and no stay operates against its sale, gift or transfer. The particulars are these: Civil Suit No. 412 of 2024 titled Balbir Chand v. Harbans Singh Gill, pending before the Civil Judge (Junior Division), Chandigarh, concerning an alleged agreement to sell; no injunction has been granted; next date 14 October 2026. The Dwelling Unit is transferable and there is no defect in its title known to the Applicants.
14. Mortgage and charge. The Applicants state that the Dwelling Unit does not stand mortgaged with any bank, financial institution or other agency, and no loan has been raised on its security. The mortgagee is Punjab National Bank, Sector 34-A Branch, Chandigarh, loan account No. 00112233445566, whose clearance or no objection dated 3 April 2026 is produced in original with this application, and the Applicants accept that the transfer will take effect subject to the prior charge of that institution until it is discharged.
15. Building violation, misuse and inspection. The Applicants state, to the best of their knowledge, that no show cause notice and no survey report in respect of building violation, misuse or unauthorised construction is pending against the Dwelling Unit. The particulars are these: Show cause notice No. CHB/EO/2023/8814 dated 9 August 2023 in respect of a covered balcony projection on the first floor, reply filed 30 August 2023, no order passed to date. The Purchaser accepts personal liability for settling every quasi-judicial proceeding pending on account of building violation, misuse or unauthorised construction in respect of the Dwelling Unit, for the composition fee and misuse charges and any other charge that may be levied or demanded at any later stage by the Board or by any other authority, and undertakes to remove or regularise any such violation, misuse or unauthorised construction in accordance with the rules and procedure.
