When you need it

A court paper, for a woman who has suffered violence at home. If you are in danger now, call the police emergency number 112 first; this application can follow. The Protection of Women from Domestic Violence Act, 2005 lets a woman who is, or has been, in a domestic relationship with the person who harms her (a husband, a partner in a relationship like marriage, or a relative she lives with) ask a Magistrate for help.

The harm covered is not only blows: it includes verbal and emotional abuse, economic abuse (such as being denied money or turned out of the house) and sexual abuse. The application can ask for several orders together: that the violence stop (a protection order), that you not be put out of the shared home (a residence order), money for your needs and the children's (monetary relief), temporary custody of the children, and compensation. It can also ask for interim orders while the case runs, and for such an order without waiting for the Respondent to appear in a case of urgency. Court papers like this are usually filed through an advocate, who signs below and files a vakalatnama; a Protection Officer or a legal services authority can also help you file. Court fee, if any, is paid at filing; the amount is set by the court office, so ask the counter or your advocate, because it is not stated here. Not for a complaint to the police about a crime, which has its own route, and not a maintenance application alone: the Application for Maintenance in this library is for that.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

This paper is not an instrument under the Indian Stamp Act, 1899: it is filed in court and bears court fee, not stamp duty. Whether any court fee is payable on an application of this kind, and how much, depends on the court and the kind of proceeding, in Punjab and in Chandigarh alike. No figure is stated here; ask the filing counter of the court or your advocate.

Registration

Not registrable: it is filed in court and becomes part of the court record. Keep certified copies of any order passed on it.

Notarisation

The paper is verified by signing the verification at its foot. Where the court asks for a supporting affidavit, it is sworn before an Oath Commissioner or a Notary; carry original photo ID.

Witnesses

No attesting witnesses sign the paper itself. Witnesses to the facts give evidence at the hearing if the court so requires.
