When you need it

Use this when a neighbour's property is harming yours and talking has not worked: water seeping through your wall or roof from their bathroom, tank or drain; construction next door that has no sanction, departs from the sanctioned plan, or builds onto your land or wall; or a nuisance such as noise, smoke, smell, waste or an obstruction. You pick which of the three it is, say what happened, and state exactly what you want done and by when.

Not an agreement between neighbours about a shared wall — use the Neighbour NOC and Party Wall Agreement. Not for a stranger or relative who has taken possession of your property — use the Legal Notice to an Unauthorised Occupant. Not a complaint to the SDM or Tehsildar or to the police; those are separate documents, and a notice to the neighbour is often sent first. Read before sending: keep the tone factual, photograph the damage with dates, and do not threaten anything the law does not allow.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

No stamp duty in Punjab or Chandigarh — a notice that demands payment, performance or the stopping of an act creates, transfers or ends no right in property, and is not a chargeable instrument under the Indian Stamp Act, 1899. Plain paper or an advocate's letterhead is enough; no e-stamp exists for a document of this kind.

Registration

Not registrable in Punjab or Chandigarh — Section 17 of the Registration Act, 1908 reaches instruments that create or transfer an interest in property, not a one-sided demand. No Sub-Registrar takes a document of this kind.

Notarisation

Not required in Punjab or Chandigarh — notarising the notice adds nothing to its effect. What matters is proof that it reached the Recipient: the registered-post receipt and acknowledgement card, courier tracking, or a signed acknowledgement of hand delivery. Keep these with the file.

Witnesses

None required in Punjab or Chandigarh — this is a one-sided notice, not an instrument two parties sign. Witnesses matter only if the notice is delivered by hand (get the receiver's name, signature and date) or affixed because the Recipient cannot be found (two independent witnesses, a note of where and when, and photographs).

SUBJECT: Notice about water seepage and leakage from the Recipient's Property into the Sender's Property affecting House No. 214, Sector 15-A, Chandigarh

Dear Sir / Madam,

1. THE PROPERTIES

1.1 The Sender owns or lawfully occupies House No. 214, Sector 15-A, Chandigarh (the Sender's Property). The Recipient owns or occupies House No. 216, Sector 15-A, Chandigarh, on the east side (the Recipient's Property), which adjoins it.

2. THE GRIEVANCE

2.1 This notice is about water seepage and leakage from the Recipient's Property into the Sender's Property.

2.2 Since June 2026 water has seeped through the common wall of the ground-floor bedroom after the Recipient built a new bathroom above it. The Sender spoke to the Recipient on 10 July and 2 August 2026 and nothing was done.

2.3 The Sender holds the following in support: Dated photographs from 12 July 2026, a plumber's inspection note, and a repair estimate of Rs 38,000.

2.4 The Sender has suffered loss, damage and inconvenience, and the Sender's use and enjoyment of the Sender's Property is being interfered with.

3. THE DEMAND

3.1 The Sender calls upon the Recipient, within 15 days of receipt of this notice, to do the following: repair the bathroom waterproofing and drain so that no water reaches the Sender's wall, and pay Rs 38,000 for the repair of the Sender's wall

3.2 Until that is done, the Recipient is called upon not to carry on, continue or add to the act complained of, and not to remove or alter anything that shows its extent.

4. IF THE RECIPIENT DOES NOT COMPLY

4.1 If the Recipient does not comply, the Sender will, without further notice, file a civil suit for a permanent and, if needed, a temporary injunction, for removal or repair of what has been done, and for damages and costs, as the Sender is advised.

4.2 The Sender may also complain to the municipal body, development authority or other authority that deals with building and sanitation in the area, and take such other lawful steps as the Sender is advised.

4.3 Nothing in this notice waives any right or remedy of the Sender. The Sender would still prefer to settle this peacefully, and is willing to meet the Recipient, with a mutual friend or elder if the Recipient wishes, to agree what is to be done.

5. SERVICE OF THIS NOTICE

5.1 This notice is served by registered post with acknowledgement due. A notice properly addressed, pre-paid and posted is presumed to have been served in the ordinary course of post (Section 27, General Clauses Act, 1897). Refusal to accept delivery will be treated as service.
