When you need it

You own one car, scooter, truck or other vehicle and cannot go to the buyer or the transport (RTO) office yourself, for example because you live abroad or in another city. You choose in the questions whether the Attorney may sell it, do the RTO paperwork only, or both.

A lowest sale price can be set, and the vehicle must not be handed over until full payment has cleared. Until the transport authority records the transfer, you remain the registered owner. Many transport offices ask for the owner in person or for Aadhaar-linked steps for some jobs, whatever this document says. Ask the office. Not for property: see the General Power of Attorney. What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

A power of attorney is chargeable with stamp duty. In Punjab and Chandigarh the amount depends on what the power covers, and this document prints no figure. Confirm the current amount at the Sub-Registrar’s counter or an authorised e-stamp vendor before you buy stamp paper.

Registration

A vehicle is movable property, so a power over it does not ordinarily need registering. The transport office will usually want it notarised, and may ask for the owner to attend or complete an Aadhaar-linked step for some jobs. Ask the office what it accepts.

Notarisation

Sign before a Notary Public in Punjab or Chandigarh. Offices and banks usually expect this. If you sign outside India, the document normally needs consular attestation or an apostille before it is accepted here; check what the receiving office wants.

Witnesses

Two adult witnesses are asked for below, as ordinary good practice. They should know both the Principal and the Attorney.

POWER OF ATTORNEY FOR VEHICLE SALE AND RTO WORK

I, Amarjit Kaur Sandhu, son/daughter/wife of Late Sh. Gurdial Singh Sandhu, residing at House No. 811, Sector 8, Chandigarh 160009 (the "Principal"), do hereby appoint, constitute and nominate:

Jaspreet Singh Sandhu, son/daughter/wife of Sh. Harbans Singh Sandhu, of House No. 22, Phase 3B1, Mohali 160059, who is my son (the "Attorney"),

to be my true and lawful attorney, in my name and on my behalf, regarding the vehicle described below, upon the terms of this Power.

1. THE VEHICLE

1.1 This Power is for the following vehicle only (the "Vehicle"): Maruti Suzuki Swift, 2019, registration number CH 01 AB 1234, chassis number X, engine number X, of which I am the registered owner. The transport office concerned is at Chandigarh.

1.2 The Attorney has no authority under this Power over any other vehicle.

2. WHAT THE ATTORNEY MAY DO

2.1 The Attorney may sell the vehicle and complete the transfer: agree the sale price, sign the sale papers, hand over the vehicle and its papers against full payment, and sign the transport authority’s transfer forms as seller.

2.2 If the Attorney sells the Vehicle, the sale price shall not be less than ₹3,50,000 (Rupees Three Lakh Fifty Thousand only).

2.3 The intended buyer is X.

2.4 If the Attorney sells the Vehicle, the price shall be received by bank transfer or demand draft, and the Attorney shall not hand over the Vehicle, its keys or its papers until the full price has cleared into the Principal's own bank account.

2.5 For the transport office work the Attorney may sign and submit applications and declarations in my name, pay the official fees and taxes, attend the office, and receive documents, certificates and plates issued in respect of the Vehicle.

3. AFTER A SALE

3.1 The Principal stays the registered owner on record until the transport authority records the transfer. If the Attorney sells the Vehicle, the Attorney shall take the buyer's identity and address proof, shall apply for the transfer within the time the Motor Vehicles Act allows, and shall give the Principal copies of every paper filed and received.

4. WHAT THE ATTORNEY MAY NOT DO

4.1 The Attorney shall not hypothecate, pledge or raise a loan against the Vehicle, shall not take it out of India, and shall not deal with any other vehicle of the Principal.

5. THE TRANSPORT OFFICE'S OWN REQUIREMENTS

5.1 If the transport office requires its own forms, the Principal's presence, or an Aadhaar-linked step for any job, the Principal will comply, without that affecting this Power for any other purpose.

6. REVOCABLE, AND ENDS ON DEATH

6.1 This is an ordinary power of attorney. The Principal may revoke it at any time by written notice to the Attorney, under s.203 of the Indian Contract Act, 1872. It ends on the Principal's death or if the Principal becomes of unsound mind, under s.201 of that Act, whatever clause 7 says about its stated duration. It is not a power coupled with an interest.
