Why you need it

When you need it

You own or are otherwise entitled to a parking space in Punjab or Chandigarh — a numbered slot in a housing society or commercial complex, a garage, or a standalone plot used for parking — and want to rent it out to someone who is not otherwise your tenant, employer or neighbour under any other agreement with you. This covers a monthly rent, which vehicle may use the space, and what happens if the space is misused or the arrangement ends. Most parking spaces inside a multi-owned building or complex cannot be exclusively possessed the way a flat can — the space sits within common or limited-common area under the building's own scheme, and what an owner or allottee can grant is ordinarily a licence to use it, not a lease transferring possession. That distinction matters: a lease of immovable property for a year or more at a yearly rent is compulsorily registrable under s.17(1)(d) of the Registration Act, 1908 read with s.107 of the Transfer of Property Act, 1882; a licence to use is not a transfer of an interest in land at all, and does not attract that requirement merely because it runs for a long time. This Agreement asks you which kind of arrangement you actually have, and is written to follow whichever answer you give — see the arrangement-type question below before assuming either. If the parking space forms part of a housing society or apartment owners association's common areas, check the society's own bye-laws or management rules before letting it to someone who is not a resident — many societies restrict or forbid this, or require the managing committee's consent. What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

Where this Agreement is a leave and licence (the first option in the arrangement-type clause below), it is not a lease and is chargeable, if at all, under Article 5 "Agreement or Memorandum of an Agreement" of Schedule 1-A to the Indian Stamp Act, 1899 as applicable to Punjab (and as extended to Chandigarh) — commonly a flat, modest figure rather than one computed on the rent. Where the Parties have instead chosen the exclusive-lease option, stamp duty is computed the way a lease's is, on rent over the term, at the rate currently in force for the term band concerned. Confirm the current figure at an e-stamp vendor (SHCIL) or the Sub-Registrar's counter (in Punjab, via igrpunjab.gov.in; in Chandigarh, at 30 Bays Building) before buying stamp paper, whichever basis applies, since this Agreement does not print a figure for either.

Registration

Where the Parties have instead chosen the exclusive-lease option and the term is a year or more, or reserves a yearly rent, s.107 of the Transfer of Property Act, 1882 requires it to be by registered instrument, and s.17(1)(d) of the Registration Act, 1908 makes it compulsorily registrable — present it at the Sub-Registrar of the tehsil where the space lies, in Punjab, or the Sub-Registrar, Union Territory of Chandigarh, in Chandigarh, within four months of execution under s.23 of that Act. An exclusive lease left unregistered when it should have been is inadmissible to prove the tenancy under s.49 of that Act.

Notarisation

Not required for either kind of arrangement, but recommended for the evidentiary weight it gives if the arrangement is later disputed, particularly for a leave and licence that will not otherwise be registered. Either Party may have their own signature notarised before an Oath Commissioner or Notary Public in Punjab or Chandigarh.

Witnesses

Not a statutory requirement for either a licence or, under the Transfer of Property Act, 1882, a lease — s.107 needs only execution by both parties for a registered lease, and a licence needs no attestation at all. Two witnesses are asked for below as ordinary good practice, and both registering offices expect them in any event if the Agreement is presented for registration.

PARKING SPACE RENT AGREEMENT

This Agreement is made at Zirakpur on 3 April 2026.

BETWEEN

Tejinder Pal Singh, of Flat No. 604, Tower C, Motia Royal Citi, Zirakpur 140603, phone 98140 33221 (the "Owner");

AND

Ashok Verma, of Flat No. 512, Tower B, Motia Royal Citi, Zirakpur 140603, phone 97790 44556 (the "Renter").

The Owner and the Renter are each a "Party" and together the "Parties".

RECITALS

A. The Owner is the owner of the unit or plot to which the parking space is allotted or attached, entitled to deal with it without any further consent, in respect of the parking space described in the Schedule to this Agreement.

B. The Owner has agreed to let the Renter use that parking space for the Renter's vehicle, described below, on the terms of this Agreement.

NOW THIS AGREEMENT WITNESSES as follows.

  1. NATURE OF THE ARRANGEMENT

1.1 This Agreement is a leave and licence, granting the Renter permission to use the parking space without any transfer of exclusive possession of, or interest in, the space.

  1. THE VEHICLE

2.1 The parking space may be used only for the Renter's a car bearing registration number CH01 AZ 4455. If the Renter wishes to park a different vehicle, the Parties shall record that change in writing before it happens.

  1. TERM

3.1 This arrangement begins on 1 April 2026 and is a fixed term ending on the end date stated below.
