When you need it

You are on the managing committee of a Resident Welfare Association, apartment owners' association or an independent-floors/villas colony association in Punjab or Chandigarh, and want a signed record of each resident's obligation to pay maintenance charges and follow common-area rules — the kind of foundation many independent colonies never put in writing, unlike a cooperative house-building society, which already has share certificates and statutory bye-laws. Use this between the Association and one resident at a time, whether owner-occupier, non-resident owner, or a tenant occupying with the owner's consent. It fixes the maintenance charge, what it is meant to cover, when it is due, and what happens on default — matters that are commonly disputed later precisely because no independent RWA (as opposed to a registered cooperative society) ever recorded them. Where the complex is a registered apartment project in Punjab, the Punjab Apartment and Property Regulation Act, 1995 (PAPRA) separately governs the association of apartment owners and the maintenance obligations the promoter must hand over — this Agreement complements that framework rather than replacing it. Where the Association is registered as a society under the Societies Registration Act, 1860, its own bye-laws control voting, general body approval of charges, and dissolution, and this Agreement should track them rather than contradict them. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

A private agreement, not a conveyance or an instrument the Indian Stamp Act, 1899 as applicable to Punjab (and as extended to Chandigarh) charges ad valorem. It falls, if at all, under Article 5 "Agreement or Memorandum of an Agreement" of Schedule 1-A, commonly a flat, modest figure — confirm the current one at an e-stamp vendor (SHCIL) or Sub-Registrar's counter before buying stamp paper, since this Agreement does not print a settled figure. Many Associations use this kind of document unstamped, relying instead on the Association's own bye-laws or rules for enforceability; stamping adds evidentiary weight but nothing in this Agreement depends on it.

Registration

Not compulsory. This Agreement creates no interest in immovable property and is not a lease, so s.17 of the Registration Act, 1908 does not reach it. It is not, itself, the Association's own registration — that is a separate step (see the Society Registration Application for registering the Association itself under the Societies Registration Act, 1860, where it is not already registered).

Notarisation

Not required, but notarising the Resident's signature, or keeping a register of these Agreements countersigned by a committee member, gives the Association firmer evidence if the Agreement is later relied on in a recovery claim.

Witnesses

Not a statutory requirement for a contract under the Indian Contract Act, 1872. Two witnesses are asked for below as ordinary good practice for a document the Association may need to produce later in a maintenance-recovery matter.

This Agreement is made at S.A.S. Nagar (Mohali) on 2 April 2026.

BETWEEN

Sunrise Enclave Residents Welfare Association, registered as a society under the Societies Registration Act, 1860, Regn. No. 1123 of 2019-20, Registrar of Societies, S.A.S. Nagar, of Community Centre, Sunrise Enclave, Sector 115, S.A.S. Nagar (Mohali) 140307, acting through Harjeet Singh Gill, President, authorised by Managing Committee resolution dated 4 January 2026 (the "Association");

AND

Deepika Chawla, the owner-occupier of the unit named above, of/at House No. 214, Sunrise Enclave, Sector 115, S.A.S. Nagar (Mohali) 140307 (the "Resident").

The Association and the Resident are each a "Party" and together the "Parties".

RECITALS

A. The Association manages the common areas, facilities and services of the colony or complex in which the unit at House No. 214, Sunrise Enclave, Sector 115, S.A.S. Nagar (Mohali) 140307 is situated, and levies maintenance charges on residents to fund that management.

B. The Parties wish to record the Resident's obligation to pay maintenance charges and to observe the Association's common-area rules, on the terms of this Agreement.

NOW THIS AGREEMENT WITNESSES as follows.

  1. MAINTENANCE CHARGE

1.1 The maintenance charge for the unit is computed on a flat rate per unit, irrespective of size.

1.3 The current monthly maintenance charge for the unit is ₹2,200 (Rupees Two Thousand Two Hundred only), payable on or before day 10 of each calendar month. The Association may revise this charge from time to time in accordance with its own rules and a General Body or Managing Committee decision, on written notice to the Resident, and the revised charge then applies in place of the figure in this clause.
