Why you need it

When you need it

For when a sale/conveyance is executed but can't register immediately — a lender, authority, or availability delay. Risk: s.23 needs presentation within 4 months (only the limited s.25 extension exists). Identify the instrument, dates, delay reason, money paid, possession, and who bears the loss from non-cooperation.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

Chargeable under Article 34 at the Article 57 security-bond rate — nominal, not ad valorem; neither state's table lists it, ask the vendor/Sub-Registrar. A combined oath declaration adds its own duty (s.5). Doesn't reduce the sale deed's own duty.

Registration

Stays compulsorily registrable (s.17); doesn't extend the s.23/25 deadlines.

Notarisation

Notarisation does not replace registration of the underlying conveyance.

Witnesses

Both parties sign; witnesses are prudent for a material indemnity.
