When you need it

A registered lease of a whole banquet hall, marriage palace or function venue, with its lawn, kitchen and parking, to an operator who will run it as a business in Punjab or Chandigarh. A venue lease carries terms an ordinary shop lease does not: the licences the operator must hold, a cut-off hour for music and noise, crowd and parking management, and what happens to wedding and function bookings already taken when the lease ends.

Use it when the term is over a year and the whole venue goes to one operator. For hiring the hall for a single function, a short booking agreement is enough. Not for a revenue-sharing arrangement where the owner keeps running the venue, or a lease by an allotting authority itself.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

Stamp duty on a lease is worked out on the rent, not the value of the premises, and the bands and rates are different in Punjab and in Chandigarh. Neither is set out here, because the tables change and are published without a date. Work out the annual average rent (the form asks for it), then check the current figure for your term with the Sub-Registrar or on the stamps and registration website of Punjab or the Chandigarh Administration before buying the e-stamp. In Chandigarh the refundable security deposit can also attract duty; ask about it. A lease for a long term, which a venue or institution may be, falls in the higher bands, so work out the term carefully. An under-stamped lease is impounded until the deficiency and penalty are paid.

Registration

A lease over a year, or at a yearly rent, must be registered before the Sub-Registrar of the area. Present the deed within four months of signing. Both the Lessor (every co-owner) and the Lessee attend in person with photo identity, PAN and photographs, or through an attorney whose power of attorney is authenticated before signing. An unregistered lease of this kind cannot be used in court to prove the tenancy. Ask the Sub-Registrar which fee and which form apply to your premises before you engross the deed; Punjab has a rent law with its own rules on written lettings that may affect the form, and where the premises come from GMADA, GLADA, PUDA or the Chandigarh Estate Office, their permission to let may be needed first.

Notarisation

Notarising a lease does not replace registration; a notarised but unregistered lease over a year still cannot prove the tenancy. Use a notary for the papers around it, such as a board resolution, a title or vacant-possession affidavit, or a no-objection from a lender. A power of attorney used to sign or present the deed needs to be authenticated for registration before the deed is signed.

Witnesses

Two adult witnesses who are not parties should sign. The Sub-Registrar's office in Chandigarh expects the first witness to be a person known to the office. Ask which witnesses are accepted when you book the appointment. What gates registration is that both parties attend in person with photo identity.
