When you need it

Most commercial tenants pay common area maintenance (CAM) and a share of property tax in monthly instalments, based on an estimate. At the end of the year the real cost is known and is almost never the same as the estimate.

This statement is how the landlord settles the difference: it sets out the real cost for the year, the tenant's share of it, what the tenant already paid on account, and the balance that one side owes the other. Use it once a year, or at the end of any period the lease sets for settling, in a lease of a shop, office, SCO, showroom or industrial unit in Punjab or Chandigarh. It is the landlord's own statement, sent to the tenant, with the cost heads listed and the supporting bills open for the tenant to inspect for a set number of days. If the tenant has a question it asks it within that time. It is a statement of account and not a demand notice, and it does not change what the lease says is payable. It states no tax rate; the property tax and any GST on CAM come from the bills and the law in force, and the statement only reports them.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

A statement of account is not an instrument that creates or transfers a right, so no stamp duty is payable on it in Punjab or Chandigarh. A settlement of a balance is done by payment or adjustment and needs no stamp.

Registration

Not required. It is not a lease and creates no interest in the premises.

Notarisation

Not required.

Witnesses

Not required. A single signature of the Landlord or its authorised person is enough.
