When you need it

A lease of commercial premises for more than a year, or from year to year, or at a yearly rent, must normally be registered. An unregistered lease that needs registration cannot be used as proof of the tenancy in a court, and the parties lose the safety they thought they had.

Most delays at the Sub-Registrar's office come from a missing paper, a witness who does not qualify, or a signatory who did not bring identity proof. This checklist walks a landlord and a tenant through registering a commercial lease in Punjab or in Chandigarh, in the order things happen: before the day, the papers each side brings, the property papers, the witnesses, the visit to the office, and what to do afterwards. You tick off each item and write the dates. It names no stamp duty or registration fee: those depend on the term and the rent, change from time to time and differ between Punjab and Chandigarh, and must be taken from the current table or the Sub-Registrar. It is a working list for the parties or their adviser. It is not signed by anyone, is not a lease, and does not replace advice on whether a particular letting must be registered.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

This checklist is not an instrument and needs no stamp. The lease it helps register is stamped on its own figures, which depend on the term and the rent and differ between Punjab and Chandigarh. Take the current figure from the stamp duty table or the Sub-Registrar; this checklist states none.

Registration

The checklist itself is not registered. The lease that it helps register is registered at the office of the Sub-Registrar within whose area the premises lie.

Notarisation

Not required for the checklist.

Witnesses

None for the checklist. The lease needs two adult witnesses who are not parties to it; see Part D.

LEASE REGISTRATION CHECKLIST

Premises: Office 304, Third Floor, Tower B, Elante Business Park, Industrial Area Phase 1, Chandigarh 160002
Landlord: Sethi Estates Private Limited
Tenant: Northline Analytics Private Limited
Term and rent: 9 years from 1 April 2026, at 85,000 a month rising 5 percent each year
Office: Sub-Registrar, Chandigarh
Planned date of visit: 1 April 2026

Tick each item when done and write the date beside it. This list names no stamp duty or fee; take current figures from the Sub-Registrar.

A. BEFORE THE DAY

[ ] Confirm with an advocate that this letting must be registered, and, in Punjab, which form the lease must take under the rent law that applies to this letting.
[ ] Settle the final text of the lease. Check names, addresses, area, rent, term and dates against the papers.
[ ] Work out the stamp duty from the current table for Punjab or Chandigarh, whichever applies to the premises, and the registration fee, or ask the Sub-Registrar.
[ ] Buy or pay for the stamp (e-stamp or stamp paper) in the name of the party who bears it. The lease and the stamp must carry the same date or the stamp must be earlier.
[ ] Print the lease on the stamp paper or attach the e-stamp certificate, with a page count that matches in every copy.
[ ] Book the registration appointment, where the office allows it, and check the office's working days and timings.
[ ] Check the time limit for presenting the lease for registration, counted from the date of signing. If the time is short, ask the advocate what to do.

B. PAPERS EACH PARTY BRINGS

[ ] Original photo identity card of each signatory and of each witness, and a copy of each.
[ ] PAN card of each party, and the GST registration if a party is registered.
[ ] Recent passport-size photographs of each signatory, as many as the office asks for.
[ ] If a party is a company or firm: the board resolution, partners' authority or other authority naming who signs, with that person's identity.
[ ] If a party signs through an attorney: the power of attorney, properly registered or authenticated, with the attorney's identity.
[ ] Mobile numbers and email addresses of both parties, for the office's OTP or contact.

C. PROPERTY PAPERS

[ ] Proof that the landlord is entitled to let the premises: sale deed, allotment letter, lease from the allotting authority, or other title paper.
[ ] In Chandigarh, if the premises are held on a lease from the Administration, check with an advocate or the estate office whether any permission or intimation is needed before it is sub-let, and bring the lease papers.
[ ] The latest property tax receipt and, where applicable, a no-dues paper from the building society or association.
[ ] A plan or description showing the area let, and a copy of any annexure that forms part of the lease, such as a list of landlord's works or fit-out rules.
[ ] Co-owners: every co-owner must sign or give a proper written authority.
