When you need it

Use this before you go to the District Consumer Commission, when goods you bought were faulty or a service you paid for fell short and the seller or provider has not put it right. The notice records what you bought, the fault, your earlier complaints, what it has cost you and exactly what you require, and gives fifteen days to do it.

A notice is not a condition for filing a consumer complaint, but it shows the Commission you gave the other side a fair last chance. Answer the questions from your bill, your messages and your earlier complaints. Gather the papers to enclose: the bill or invoice, proof of payment, the warranty card, photographs and your earlier complaints. Send the signed notice by registered post with acknowledgement due or speed post, to the seller or provider at the address on the bill, and by email if you have one; keep the postal receipt and the tracking report, because the day it reaches them starts the fifteen days. A consumer complaint must be filed within two years of the day the cause of action arose, and the notice does not stop that time running. If fifteen days pass with no answer, file the Consumer Commission Complaint.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

Punjab and Chandigarh: no stamp duty is payable. A notice demanding a refund, repair or compensation creates, transfers or extinguishes no right, so it is not an instrument within section 2(14) of the Indian Stamp Act, 1899, and the sender signs it alone.

Registration

Punjab and Chandigarh: not registrable. A notice creates or transfers no right in immovable property, so section 17(1)(b) of the Registration Act, 1908 does not reach it. Keep the postal receipt, the tracking report and the acknowledgement, since the day of delivery starts the fifteen days.

Notarisation

Punjab and Chandigarh: no notarisation is needed. What gives the notice its use is that it is in writing, is dated and reaches the other side, not any attestation of the sender's signature.

Witnesses

Punjab and Chandigarh: no witness is needed. The sender signs alone, and the postal or courier record proves delivery.

LEGAL NOTICE FOR DEFECTIVE PRODUCT OR DEFICIENT SERVICE

Notice before a consumer complaint, under the Consumer Protection Act, 2019

Date: 3 April 2026, at Patiala

I am sending this notice by registered post with acknowledgement due. I am also emailing a copy to info@bajwafurniture.example.com.

To: Bajwa Furniture House, Shop 12, Leela Bhawan Market, Patiala 147001; with a copy to Zenith Home Appliances Pvt Ltd, 14 Industrial Area, Phase 2, Chandigarh 160002, the manufacturer

From: Gurpreet Singh Dhillon, House No. 88, Urban Estate Phase 2, Patiala 147002 (email gurpreet.dhillon@example.com, telephone +91 98150 47731)

Subject: Defective sofa set supplied against invoice No. BF/2026/932 dated 4 August 2026

Sir or Madam,

  1. 1. What I bought or hired. On 1 April 2026 I bought goods from you and paid ₹72,000 (Rupees Seventy Two Thousand only) by UPI transfer on 4 August 2026. The bill or receipt is invoice No. BF/2026/932 dated 4 August 2026. A five-seater sofa set in solid sheesham wood and leatherette, delivered on 10 August 2026, which the shop described as a ten-year frame with a two-year upholstery warranty.
  1. 2. What is wrong. Within three weeks the leatherette peeled off both armrests and one leg of the three-seater split along the joint, so the sofa rocks when anyone sits on it. I first noticed this on 2 April 2026.
  1. 3. What I have already done. I phoned the shop on 2 September 2026 and visited on 6 September 2026, when the manager promised to send a carpenter. No one came. I messaged on 14 and 22 September 2026. Your reply was: The manager said on 25 September 2026 that the damage was caused by use and would not be covered.
  1. 4. Why I call this a defect or a deficiency. What you supplied does not do what it was sold or promised to do. In the Consumer Protection Act, 2019, a defect is a fault or shortcoming in the quality, quantity, potency, purity or standard of goods, and a deficiency is a fault or shortcoming in the quality, nature or manner of performance of a service. You promised a ten-year frame and a two-year upholstery warranty, and the fault appeared within the first month.
  1. 5. What it has cost me. I cannot use the sofa set, I have lost working time on three days waiting for the carpenter, and I have had to borrow chairs for the household. The money I have spent because of it, apart from the price, is ₹3,500 (Rupees Three Thousand Five Hundred only).
  1. 6. What I require. Within fifteen days of receiving this notice, refund the price paid, with interest at the rate of 9% a year from the date of purchase. I also require you to pay me ₹15,000 (Rupees Fifteen Thousand only) as compensation for the loss and trouble described in paragraph 5, being the cost of borrowed chairs, the time lost and the repeated trouble. Please pay by transfer to my savings account No. 3318002100045512 with Punjab National Bank, Urban Estate branch, Patiala, IFSC PUNB0331800, or by demand draft payable to me delivered at my address above.
