Stamp duty
Filed in a pending case, an affidavit is ordinarily exempt from the nominal affidavit duty (Article 4, Schedule I-A for Punjab or Schedule I for Chandigarh) and instead carries only the court's own court-fee stamp, if any; the court-fee figure was not confirmed here, so confirm the current amount at the court's filing counter.
Registration
Not registrable: a court paper is not an instrument under section 17 of the Registration Act, 1908.
Witnesses
None required for the affidavit itself.

When you need it

A witness's sworn statement of what they know, filed in a civil suit in place of giving the main part of their evidence orally (Order XVIII Rule 4 of the Code of Civil Procedure, 1908). The plaintiff, the defendant or any other witness can file one.

The witness is still questioned by the other side, so they must attend court on the date fixed. The affidavit should hold only facts the witness personally knows; anything based on information should say so and give the reason. It is not a general-purpose affidavit and it is not the affidavit that goes with a plaint or an application. For those, use the General Court Affidavit in this library. Court papers are usually filed through an advocate, who also files a vakalatnama; this form prepares the draft for them to settle.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Any decree that results has its own registration or mutation step, if one is needed.

Notarisation

Required: an unsworn affidavit is only a signed statement. It is sworn before an Oath Commissioner or Notary, or before the court itself where the court administers the oath; the deponent appears in person with photo identification.

Witnesses

None required for the affidavit itself. The witness gives oral evidence in cross-examination later, in the court's own procedure.
