When you need it

A court in Punjab or Chandigarh has granted someone bail on condition that a surety stands guarantee, and you have agreed to be that surety. The surety binds himself or herself that the accused will attend court on every date and obey the bail conditions, and agrees that the bond amount can be forfeited from the surety and the surety's property if the accused does not.

The solvency affidavit that goes with it tells the court how the surety earns a living, what property the surety owns and what it is worth, whether it is mortgaged or claimed, and whether the surety has stood surety elsewhere, so that the court can see the bond amount is covered. It also carries the surety's promise that nobody has paid or promised anything for standing surety. Court papers are usually filed through an advocate; you may file in person, and if an advocate files it for you, enter the advocate's name and address (optional). The court fixes the bond amount, decides whether to accept the surety and may ask for more proof; stamp duty on a bond and the court fee are confirmed at the filing counter. It is also used where a court asks for a surety on release of seized property (see the Superdari Application for Seized Property), with the facts changed. Standing surety is a real risk: if the accused absconds, the surety can lose the bond amount.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

The court's own court-fee stamp, fixed by the court office, is payable on the filing; the amount is not given here because no single figure common to every court has been confirmed, so confirm the current figure at the filing counter of the court. The affidavit that goes with it is ordinarily exempt from the nominal affidavit duty under Article 4, Schedule I-A (Punjab) or Schedule I (Chandigarh) when filed in a pending court proceeding, and otherwise carries that nominal duty; confirm that at the counter too. A surety bond may attract its own stamp duty as a bond; that is not given here because the figure has not been confirmed, so ask at the filing counter.

Registration

Punjab and Chandigarh: not registrable. It is lodged with the court's own registry, becomes part of the record of the case, and is not a document that the Registration Act, 1908 reaches.

Notarisation

Punjab and Chandigarh: the affidavit that goes with it is sworn before a Notary Public, an Oath Commissioner attached to the court, or the court itself, as for any other verified paper. The deponent appears in person with photo identification.

Witnesses

Punjab and Chandigarh: no attesting witness signs it. The signature of the party and, where an advocate files it, the advocate's signature are the whole formality. Court papers are usually filed through an advocate; you may file in person, and if an advocate files it for you, enter the advocate's name and address (optional).
