When you need it

A court in Punjab or Chandigarh has passed an order or judgment in your case and you need the official certified copy of it, for an appeal, to execute it, for a mutation or a bank, or for another office that will not take a plain photocopy. This application goes to the court's office that issues certified copies.

It names the court and case, who you are in the case, the date and kind of the order, how many copies you need and why, and how you will receive them. It undertakes to pay the fee and supply the stamps the court office asks for. It can be made by a party, by the advocate for a party, or by another person with an interest. Court applications are usually filed through an advocate; you may file in person, and if an advocate files it for you, enter the advocate's name and address (optional). Check the court fee and the stamps at the court's copying office; the amount depends on the pages and copies. Not for a certified copy of a registered deed from the Sub-Registrar (see the Application for a Certified Copy of a Registered Deed (Nakal)); and a certified copy of an order of the Punjab and Haryana High Court follows that court's own rules.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

Punjab and Chandigarh: the court's own fee and stamps for certified copies are payable when the application is accepted, and the amount depends on the number of pages and copies; no figure is given here because none has been confirmed, so ask at the court's copying office. There is no separate stamp duty on this application. Court papers are usually filed through an advocate; you may file in person, and if an advocate files it for you, enter the advocate's name and address (optional).

Registration

Punjab and Chandigarh: not registrable. It is lodged with the court's own registry, becomes part of the record of the case, and is not a document that the Registration Act, 1908 reaches.

Notarisation

Punjab and Chandigarh: no notary is needed and no affidavit goes with it. The applicant signs; the court office may ask to see photo identification.

Witnesses

Punjab and Chandigarh: no attesting witness signs it. The signature of the party and, where an advocate files it, the advocate's signature are the whole formality.

APPLICANT

LEGAL BASIS

Punjab: A party to a case, and in some cases another person with an interest, may obtain a certified copy of an order or judgment from the court that passed it by applying to the office that issues certified copies and paying the prescribed fee and stamps. A certified copy of a court record is a public document and is accepted as proof of what the record says. The section of the Bharatiya Sakshya Adhiniyam, 2023 that says so, and the court rules that fix the fee and the time for supply, have not been confirmed, so none is cited here.

Chandigarh: The same applies in the courts at Chandigarh. A certified copy of an order of the Punjab and Haryana High Court is applied for under that court's own rules, not under this form.

PERSONAL DATA NOTICE

This notice is given under the Digital Personal Data Protection Act, 2023.

The purpose of collecting the personal data in this document is to identify the applicant and the order asked for, and to record the request, so that the court office can prepare, certify and give the copies.

The record will be held by Kuldip Singh Sandhu and may be shared with the applicant, the court and its copying office, and the applicant's advocate.

If the matter does not proceed, the personal data will be retained for 90 days and then erased. If the matter proceeds, the record will be retained for the transaction or authority matter plus 12 months, except where a statute requires a longer named retention period.
