RERA SECTION 13 CAPS WHAT CAN BE COLLECTED AT THIS STAGE. Section 13 of the Real Estate (Regulation and Development) Act, 2016 bars a promoter from accepting more than ten per cent of the cost of the apartment or plot as an advance payment or application fee before first entering into a registered agreement for sale. This allotment letter is not that agreement — it is the confirmation that precedes it — so the booking amount it records should not exceed that ten per cent, and the rest of the price should be scheduled to fall due only once the Builder-Buyer Agreement is actually signed and registered. This booking amount does not exceed ten per cent of the total consideration, consistently with section 13 of the Real Estate (Regulation and Development) Act, 2016, which bars us from accepting more than that proportion before we enter into a registered Builder-Buyer Agreement with you.

Payment plan: Construction-linked plan, as detailed in the payment schedule below

Payment schedule: 15% within 30 days of allotment, against and only upon execution and registration of the Builder-Buyer Agreement; remaining instalments linked to construction milestones as detailed in the Builder-Buyer Agreement.

BUILDER-BUYER AGREEMENT

We shall execute the Builder-Buyer Agreement with you within 30 days of this letter. No instalment beyond the booking amount already received shall be sought from you before that Agreement is executed and registered.

CANCELLATION

The booking amount, less the forfeiture stated below, is refunded within the refund period stated below. Forfeiture on cancellation is capped at 10% of the booking amount, and any refund due is processed within 45 days, with interest at 25,000% per annum on a delayed refund.
