When you need it

A promoter is selling plots in a developed or part-developed colony in Punjab and you are buying one directly from the promoter. This agreement records the plot, the price and the payment schedule, the development works the promoter will complete (roads, sewer, water, electricity, parks), the date of possession, interest for delay as the real estate law allows, the sale deed and who bears stamp duty, and what happens if the buyer misses payments.

The promoter should show you the colony's approvals and RERA registration before you pay, and you should check them yourself. Have the agreement stamped and registered as the Sub-Registrar requires before paying more than the law allows as an advance. Not for a resale between two private owners — use the Agreement to Sell a Plot. Not for a flat or a built-up unit — use the Builder-Buyer Agreement – Residential Flat.

What follows is written for Punjab. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

PUNJAB: unpublished — Article 5, Sch.I-A (entry 5(c) without possession, 5(cc) with); ask the tehsil Sub-Registrar what it comes to before buying paper. If possession passes under the agreement, the Collector may charge the conveyance rate and registration becomes compulsory (section 17(1A) of the Registration Act). Stamp before signing: an unstamped agreement is inadmissible until duty plus penalty is paid (section 35 of the Stamp Act).

Registration

Earnest money alone isn't registrable; an agreement that gives possession is, compulsorily, under section 17(1A) of the Registration Act. For a registered colony, an agreement for sale should in any case be registered before more than the permitted advance is taken (section 13 of the Real Estate (Regulation and Development) Act, 2016).

Notarisation

No substitute for registration; creates no enforceability alone.

Witnesses

Two witnesses help evidence execution, not replace registration.
