Why you need it

When you need it

You are engaging a driver, cook, maid, nanny, gardener or other domestic help in Punjab or Chandigarh, directly and not through an agency, and want the terms in writing — duties, hours, wages, leave, notice, and what happens to a vehicle a driver is trusted with. It sets out a plain employer-employee relationship of personal service, not a licence to occupy any part of your home and not an engagement through a placement or security agency. Get the Employee Police Verification Form done, or at least applied for, before or alongside this Agreement — this document assumes that step is being handled separately and does not itself verify anyone's antecedents. Domestic work is not, by default, a "scheduled employment" under the Minimum Wages Act, 1948 the way factory or shop work commonly is; whether Punjab has specifically notified domestic service, or a category of it, as scheduled employment is a question of current notification and this Agreement is drafted to track whichever answer applies rather than assert one. Not for a security guard supplied by a licensed private security agency — see the Security Agency Agreement for that, since the agency, not you, is the guard's employer there.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

A private contract of personal service between two individuals, not a conveyance, lease or instrument the Indian Stamp Act, 1899 as applicable to Punjab (and as extended to the Union Territory of Chandigarh) taxes ad valorem. It falls, if at all, under Article 5 "Agreement or Memorandum of an Agreement" of Schedule 1-A, which in recent years has commonly been charged at a flat rate of around Rs 100 for an agreement of this kind rather than by reference to the wages payable — confirm the figure currently charged at an e-stamp vendor (SHCIL) or Sub-Registrar's counter in Punjab, or the Chandigarh Sub-Registrar, before buying stamp paper, since flat-rate figures are revised from time to time and this Agreement does not print one as settled. Printing this Agreement on stamp paper of that value, or e-stamping it, is good practice for evidentiary weight in a wage or termination dispute, though not compelled by any registration requirement.

Registration

Not compulsory. This Agreement creates no interest in immovable property and grants no lease or licence of any part of the Employer's premises even where the Employee lives in, so s.17 of the Registration Act, 1908 does not reach it. It may be registered as an optional document under s.18 of that Act if either party wants the extra evidentiary weight, at the Sub-Registrar of the tehsil in Punjab or the Sub-Registrar, Union Territory of Chandigarh, but almost nobody does this for a domestic employment contract, and nothing in this Agreement depends on registration.

Notarisation

Not required, but recommended for the same reason registration is optional here: a notarised copy is easier to rely on later if wages, hours or the circumstances of ending the engagement are disputed. Either party may have their own signature notarised before an Oath Commissioner or Notary Public in Punjab or Chandigarh; notarising both signatures together needs both to attend.

Witnesses

Not a statutory requirement for a contract under the Indian Contract Act, 1872, which needs no attestation to be valid. Two witnesses are nonetheless asked for below as ordinary good practice for a document that may later be produced in a wage or dismissal dispute, and cost nothing to obtain at the time of signing.

DRIVER / DOMESTIC HELP AGREEMENT

This Agreement is made at S.A.S. Nagar (Mohali) on 1 April 2026.

BETWEEN

Neena Kapoor, of House No. 3042, Sector 71, S.A.S. Nagar (Mohali) 160071, phone 98140 55667 (the "Employer");

AND

Ramesh Chand, son/daughter/wife of Mohan Lal, of Vill. Rurki, P.O. Rurki, Tehsil Kharar, District S.A.S. Nagar, Punjab 140301, phone 97890 11223, holding Aadhaar 4321 XXXX XXXX as identity proof (the "Employee").

The Employer and the Employee are each a "Party" and together the "Parties".

RECITALS

A. The Employer wishes to engage the Employee as a driver, and the Employee has agreed to serve the Employer on the terms of this Agreement.

B. The Employer confirms that police verification of the Employee, under the Employee Police Verification Form or an equivalent application to the local police, has been applied for or will be applied for separately from this Agreement. Reference: Chandigarh Police portal ref. no. CHDPV/2026/004521, applied 2 March 2026.

NOW THIS AGREEMENT WITNESSES as follows.

  1. NATURE OF ENGAGEMENT

1.1 This is a contract of personal service between the Employer and the Employee directly. It is not a licence of any part of the Employer's premises to the Employee, and the Employee acquires no right to remain at the premises beyond the engagement, whether or not accommodation is provided under clause 4.

1.2 The engagement commences on 2 April 2026.

  1. DUTIES

2.1 The Employee's duties are: Driving the family car for school drop and pick-up, office commute and errands; basic cleaning and maintenance of the vehicle; running local errands as directed..

2.2 Vehicle: The Employee shall drive the following vehicle(s) in the course of their duties: Maruti Suzuki Ertiga, PB 65 AB 4321. The Employee holds driving licence number and class: PB0320180012345, LMV, and shall keep that licence valid throughout the engagement, informing the Employer at once if it is suspended, cancelled or expires. The Employee shall drive carefully and in accordance with the Motor Vehicles Act, 1988 and the rules made under it, shall not drive under the influence of alcohol or any intoxicant, and shall not permit any other person to drive the vehicle without the Employer's express permission.
