Why you need it

When you need it

You run a business, house, RWA or institution in Punjab or Chandigarh and want to engage a licensed private security agency to supply guards, rather than employ guards directly. It fixes how many guards, at which sites, on what shifts, at what monthly charge, and puts on record the Agency's obligations: a valid licence under the Private Security Agencies (Regulation) Act, 2005 (PSARA), antecedent verification and training of every guard it deploys, and the Agency's own responsibility as the guards' employer for their wages and statutory dues. Every private security agency operating in India must hold a PSARA licence from the Controlling Authority of the State or Union Territory where it operates — in Punjab, the authority notified under the Punjab Private Security Agencies Rules; in Chandigarh, the Controlling Authority for the Union Territory. Ask for the licence and check its validity before signing; this Agreement records the licence particulars the Agency gives but does not itself verify them. Not for a driver, cook, maid or other individual you engage and pay directly — see the Driver / Domestic Help Agreement for that, since there the person is your own employee and not the agency's.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

A services agreement, not a conveyance or an instrument the Indian Stamp Act, 1899 as applicable to Punjab (and as extended to Chandigarh) charges ad valorem. It falls, if at all, under Article 5 "Agreement or Memorandum of an Agreement" of Schedule 1-A, commonly charged at a flat rate rather than by reference to the contract value for an agreement of this kind — confirm the figure currently charged at an e-stamp vendor (SHCIL) or Sub-Registrar's counter in Punjab, or the Chandigarh Sub-Registrar, before buying stamp paper, since this Agreement does not print a settled figure. Printing on stamp paper of that value, or e-stamping it, is good practice for a document both sides may need to rely on, though nothing in it depends on stamping being done.

Registration

Not compulsory. This Agreement creates no interest in immovable property and is not a lease, so s.17 of the Registration Act, 1908 does not reach it. It may be registered as an optional document under s.18 of that Act if either side wants the added evidentiary weight, at the Sub-Registrar of the tehsil in Punjab or the Sub-Registrar, Union Territory of Chandigarh, but this is unusual for a security services contract and nothing in this Agreement depends on it.

Notarisation

Not required. Keep a copy of the Agency's PSARA licence, and check its validity independently on the issuing State's or Union Territory's own records where that facility exists, rather than relying only on the copy the Agency gives you. Notarising the signature page adds evidentiary weight if the Agreement is later disputed, but is not compelled by any Act.

Witnesses

Not a statutory requirement for a contract under the Indian Contract Act, 1872. Two witnesses are asked for below as ordinary good practice, and cost nothing to obtain at the time of signing.

SECURITY AGENCY AGREEMENT

This Agreement is made at S.A.S. Nagar (Mohali) on 1 April 2026.

BETWEEN

Sunrise Residents Welfare Association, an individual householder, of Sunrise Enclave, Sector 115, S.A.S. Nagar (Mohali) 140307, phone 98140 66778, acting through Harjeet Singh Gill, President, authorised by the Managing Committee resolution dated 4 March 2026 (the "Client");

AND

Secure Force Security Services Private Limited, of SCO 84, Sector 34-A, Chandigarh 160022, acting through Vikram Ahluwalia, Director, holding licence no. CH/PSARA/2019/0231 issued by the Controlling Authority (PSARA), Union Territory of Chandigarh under the Private Security Agencies (Regulation) Act, 2005, valid until 3 April 2026 (the "Agency").

The Client and the Agency are each a "Party" and together the "Parties".

RECITALS

A. The Client wishes to engage the Agency to supply, deploy and supervise security guards at the site(s) described below, and the Agency has agreed to do so on the terms of this Agreement.

B. The Agency confirms that it holds a subsisting licence under the Private Security Agencies (Regulation) Act, 2005 for the jurisdiction in which the site(s) are situated, that every guard it deploys under this Agreement has undergone the verification of antecedents required by s.9 of that Act and the training prescribed under it, and that it will keep that licence current for the term of this Agreement.

C. The Agency, and not the Client, is the employer of every guard deployed under this Agreement.

NOW THIS AGREEMENT WITNESSES as follows.

SCOPE OF SERVICES

1.1 The Agency shall supply, at the Client's site(s) described in clause 2, security guards to perform watch and ward duties, access control and such other security-related duties as the Client reasonably directs, consistently with the Agency's licence and applicable law.

SITE, GUARDS AND SHIFTS

2.1 Site(s): Main gate and the three residential towers of Sunrise Enclave, Sector 115, S.A.S. Nagar (Mohali).

2.2 The Agency shall deploy 4 guard(s) at the site(s) at any one time, on the following shift pattern: Two shifts of twelve hours each (6 am to 6 pm and 6 pm to 6 am), one guard per post per shift.

2.3 unarmed guards only.

2.4 Supervision: A field supervisor visits each site at least once during each shift and is reachable at all times.

2.5 Uniform and equipment: Uniform, ID card, torch, lathi, whistle and a walkie-talkie set per post, to be provided by the Agency at its own cost and kept in good order.
