Why you need it

When you need it

Ask the lender to change an already-sanctioned amount after a change in price, contribution, income or leverage. A reduction isn't mere arithmetic once part-disbursed; an increase needs fresh eligibility, LTV and repayment checks. State current/revised amounts, direction, revised value, margin and disbursement position — a higher price doesn't automatically mean more finance.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

No stamp duty — not an 'instrument' under s.2(14), Indian Stamp Act 1899. Plain paper; the loan agreement, deposit memorandum, mortgage and guarantee are stamped separately.

Registration

Not registrable (s.17, Registration Act 1908). The mortgage itself needs registration if Rs 100+, unless by deposit of title deeds — two witnesses (s.59, TPA 1882).

Notarisation

Not required unless the lender wants an affidavit.

Witnesses

Not required; borrower signatures and documents matter more.
