When you need it

Use this when an insurer has rejected your claim, paid only part of it, or sat on it without a decision, and you want to appeal to the insurer's own grievance redressal officer before going further. The letter names the policy and the claim, sets out the reason the insurer gave, says why you think it is wrong in your own words, and asks for the decision to be looked at again and the claim paid.

It fits a motor, health, life, travel or home claim. Answer from the rejection letter and the policy; copy the claim number, the date and the reason the insurer gave exactly, and say what you disagree with and why. Papers to attach: the rejection or part-payment letter; the policy schedule and the policy wording; your claim letter and the claim form; the bills, reports and other papers you gave with the claim; all the letters and emails exchanged with the insurer; and your identity proof with the Aadhaar number masked. If you have registered the complaint on the insurance regulator's Bima Bharosa grievance portal, give the complaint number. No stamp duty or registration is needed. Send the appeal to the grievance redressal officer named on the insurer's website or the rejection letter, by email and by registered post, and keep the proofs. If the officer's answer does not satisfy you, or you hear nothing, you can use the Complaint to Insurance Ombudsman.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

Punjab and Chandigarh: no stamp duty is payable. An appeal to an insurer's grievance officer asks for a decision to be reconsidered and creates, transfers or extinguishes no right, so it is not an instrument within section 2(14) of the Indian Stamp Act, 1899. The appellant signs it alone.

Registration

Punjab and Chandigarh: not registrable. An appeal about an insurance claim touches no immovable property, so section 17(1)(b) of the Registration Act, 1908 does not reach it. The proof of posting or the email receipt is the record that matters, because the Insurance Ombudsman asks when the insurer was first approached.

Notarisation

Punjab and Chandigarh: no notarisation is needed. The grievance officer does not require a sworn statement to hear an appeal.

Witnesses

Punjab and Chandigarh: no witness is needed. The appellant signs alone.

APPEAL AGAINST CLAIM REJECTION

Appeal to the Grievance Redressal Officer against the rejection or part-payment of an insurance claim

Date: 3 April 2026, at Ludhiana

I am delivering this letter by hand and keeping the stamped copy.

To: The Grievance Redressal Officer, HDFC ERGO General Insurance Company Limited, Grievance Cell, 1st Floor, SCO 32, Sector 8-C, Chandigarh 160009

From: Manpreet Singh Sidhu, House No. 77, Sector 21-A, Chandigarh 160022 (email manpreet.sidhu@example.com, telephone +91 98723 40018)

Subject: Appeal against the decision on claim no. CLM/2026/448821 under policy no. 2315/0098/2026/00821

Sir or Madam,

  1. 1. Who I am. I am the policyholder under policy no. 2315/0098/2026/00821 issued by you, which is a family floater health policy valid from 1 April 2026 to 31 March 2027.
  1. 2. The claim. I made a claim, no. CLM/2026/448821, on 1 April 2026 for the hospital treatment of my wife for a gall bladder operation. The amount of the claim was ₹1,42,000 (Rupees One Lakh Forty Two Thousand only).
  1. 3. Your decision. By your letter dated 2 April 2026, ref no. HE/REJ/2026/7731, you rejected the whole claim. The reason you gave was: The treatment is said to be for a pre-existing condition that was not disclosed at the time of proposal.
  1. 4. Why I disagree. My wife had no gall bladder complaint before the policy began. The first scan was on 1 September 2026 and no doctor treated her earlier.
  1. 5. The facts as I say them to be. The scan report of 1 September 2026 and the doctor's note of 3 September 2026 say that the stones were found for the first time then.
  1. 6. The policy. I have read the policy wording, and I say the clause relied on does not apply to this claim for the reasons above.
  1. 7. What I ask you to do. Please do all of the following.

(a) Look at the decision afresh, with the papers I have enclosed, and not merely repeat the reason already given.

(b) Withdraw the rejection or the deduction and pay the claim, in full, being the amount claimed

(c) If you do not agree, tell me in writing, with the clause of the policy and the fact you rely on for each ground, and send me the surveyor's, doctor's or investigator's report that was used.

(d) Give your decision within the time the rules on policyholders' interests allow, and tell me the date by which you will do so.

  1. 8. Earlier steps. I wrote to the claims office on 16 October 2026 and spoke to its manager on 20 October 2026; I received no change. I have also lodged the complaint on the insurance regulator's Bima Bharosa grievance portal, complaint no. BB-2026-221140.
  1. 9. What I promise. What I have written is true to the best of my knowledge, and I have not kept back any fact that you would reasonably want to know.
  1. 10. If this appeal fails. If you uphold the rejection, give only part relief or do not reply, I will complain to the Insurance Ombudsman for the area, and I am free to bring a consumer complaint before the District Consumer Disputes Redressal Commission. I ask that you treat this letter as the written representation to the insurer that the Ombudsman's rules look for.
