When you need it

Use this when you or a member of your family is insured under a health or mediclaim policy and has been treated in hospital, and you want to tell the insurer or its claims administrator and ask for the cost to be paid. It works for a claim after discharge, where you paid the hospital and want the money back, and for a cashless request that was refused or left unanswered, where you ask the insurer to look at it again.

It gives the policy and patient details, the illness and treatment, the dates of admission and discharge, the amount claimed and where to pay. Answer from the policy schedule and the hospital's discharge summary; say plainly whether the illness was known before the policy began and whether you have another health policy, because the insurer will ask. Papers to attach: the policy schedule and health card; the claim form completed and signed; the original hospital bills and receipts; the discharge summary; the doctor's prescriptions and investigation reports; the doctor's note on the cause of the illness; identity proof with the Aadhaar number masked; and a cancelled cheque. Send the claim within the time the policy allows; if you are late, say why. No stamp duty or registration is needed. Send the letter to the claims office or the insurer's health claims address, by hand against a stamped copy, by email with the sent copy kept, or by registered post. If the claim is rejected or not answered, use the Appeal Against Claim Rejection and then the Complaint to Insurance Ombudsman.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

Punjab and Chandigarh: no stamp duty is payable. A claim letter to a health insurer asks it to perform its own contract and creates, transfers or extinguishes no right, so it is not an instrument within section 2(14) of the Indian Stamp Act, 1899, and one person signs it. A hospital may separately ask for an undertaking or an authority letter; those are other papers.

Registration

Punjab and Chandigarh: not registrable. A claim for the cost of medical treatment touches no immovable property and so lies outside section 17(1)(b) of the Registration Act, 1908. Keep the stamped copy or the delivery receipt as proof of the day the claim was lodged.

Notarisation

Punjab and Chandigarh: no notarisation is needed. The insurer may ask for a sworn statement if a bill or a document is lost; ask the claims office which of its papers it wants sworn.

Witnesses

Punjab and Chandigarh: no witness is needed. The claimant signs alone. The claim form may need the treating doctor's or the hospital's signature and seal.
