When you need it

Use this to write the text of a notice you will publish in a newspaper. You choose one of three kinds. A lost document: you have lost an original such as a title deed, share certificate, marksheet or vehicle paper and want anyone who finds it, or claims it, to come forward.

A change of name: you have changed your name and want it on public record. A property caution: you want to warn the public not to deal with your property, for example after a title deed was lost or a document was misused. The text is ready to hand to the newspaper's advertisement desk. Not the Public Notice Inviting Claims and Objections Before Purchase, which a buyer's advocate publishes before buying a property. Not the Lost Document Affidavit or the name change affidavits, which are sworn separately and are often needed as well. Not the Gazette name change application. Read before publishing: use a newspaper that circulates where you and the property live, in English and Punjabi where you can, and keep the cutting and the receipt. A newspaper notice is a warning and a record; it does not itself change your name or cancel a lost paper.

What follows is written for Punjab and Chandigarh. It states the position there rather than describing how it varies, so the amounts below are the ones that apply — worth confirming at the sub-registrar’s office, because rates change. If the property is anywhere else in India, none of this is yours.

Stamp duty

No stamp duty in Punjab or Chandigarh — a newspaper notice creates, transfers or ends no right in property and is not a chargeable instrument under the Indian Stamp Act, 1899. It is typed or handed over to the newspaper on plain paper; the only cost is the newspaper's advertisement charge.

Registration

Not registrable in Punjab or Chandigarh — Section 17 of the Registration Act, 1908 reaches instruments that create or transfer an interest in property, not a notice published to the public. No Sub-Registrar takes a document of this kind.

Notarisation

Not required in Punjab or Chandigarh to publish the notice. A newspaper advertisement desk may ask for proof of identity and, for a change of name, for the sworn affidavit, which is a separate document; keep the cutting of the published notice and the receipt of payment with your papers.

Witnesses

None required in Punjab or Chandigarh — the notice is a one-sided statement by the person issuing it. If the notice relies on a police report or an affidavit, keep those with the cutting.
